Title: Health Services Department recommending the Board authorize the Chair to sign the following amendments to Alcohol and Drug Program (ADP) Agreements for treatment service Contractors: 1) Family Connections - Amendment II to Agreement 053-110-P-E2010, increasing the provisional amount by $26,007 for a new provisional amount of $63,430; 2) Progress House - Amendment I to Agreement 097-116-P-E2009, increasing the not-to-exceed amount of the Agreement by $52,000 for a new not-to-exceed amount of $186,000; and 3) Progress House - Amendment II to Agreement 097-135-P-E2009, increasing the not-to-exceed amount of the Agreement by $10,000 for a new not-to-exceed amount of $215,000. FUNDING: State Department of Alcohol and Drug Negotiated Net Amount (NNA) Agreement; Department of Justice - Office of Justice Programs; and the Recovery Act - Justice Assistance Grant.

Fiscal Impact/Change to Net County Cost:   There is no Net County Cost associated with these three (3) Amendments to the above-noted contracts. There are sufficient funds in the ADP fund balance for these Amendments.
Background:    In the fourth quarter of fiscal year 2010-11, the ADP Program staff identified unexpended funds from three funding sources and worked with the treatment service Contractors to determine whether these funds could be appropriately utilized for treatment services. Each Contractor identified treatment services provided to clients eligible for the programs that were not yet funded by the County. At this time the Department recommends the Board approve the aforementioned Amendments to allow payment to the Contractors for services provided.
 
Compensation:
1.      Family Connections - Payment within forty-five (45) days upon approval of detailed invoices, pursuant to terms and conditions of Agreement.
2.      Progress House - Both Agreements provide for payment within forty-five (45) days upon approval of detailed invoices, pursuant to terms and conditions of Agreements.
 
Termination:
1.      Family Connections - County may terminate upon seven (7) calendar days written notice without cause.
2.      Progress House - County may terminate either Agreement upon seven (7) calendar days written notice without cause.
 
Retroactive Term:
Of the three (3) Amendments, Family Connections expired June 30, 2011; Progress House 097-116-P-E2009 expires August 31, 2011; and Progress House 097-135-P-E2009 expires September 30, 2011. Department is submitting these Amendments to the Board at this time to A) allow Department sufficient time to verify all invoices for FY 2010-11 (now completed) and B) to obtain approval prior to fiscal year end close to allow payment and accrual for services provided during FY 2010-11.
 
Reason for Recommendation:   Approval of these three (3) Amendments will allow Department to pay Contractors for services appropriately provided to eligible clients under each funding source, and maximize utilization of funds within the ADP fund balance.
Action to be taken following Board approval:
1.      Chair to sign three (3) Amendments for each of the following Agreements: 053-1110-P-E2010l 097-116-P-E2009; and 097-135-P-E2009.
2.      Board Clerk's Office to return two (2) signed Amendments for each Agreement.
3.      Department to distribute documents as appropriate.
