FIscal Impact/Change to Net County Cost:
 
The initial Road Improvement Agreement (RIA) for the White Rock Road Widening STA 63+25 to STA 115+25 (Project) was approved by the Board of Supervisors (Board) on July 20, 2004.  The Engineer's Estimate was $6,564,335.00,  including contingency, engineering and inspection costs.  The Project was advanced by the Developer.  The estimated reimbursement of $4,150,000 is based on the lowest bid of $3,186,625.00, plus contingency, engineering and inspection costs.  The actual project costs will be defined in the Reimbursement Agreement to be reimbursed from Traffic Impact Mitigation (TIM) fees and will be presented to the Board at a future date.
 
The extension and construction of a Con-Span structure under White Rock Road (Additional Work) was outlined in Amendment I to the RIA and was for a not-to-exceed amount of $350,000.  Reimbursement of the actual project costs associated with the Additional Work will be paid 90 days after the road is accepted and the County receives documented invoices substantiating the reimbursement claims for the Additional Work. Funding for this improvements will also be provided from (TIM) fees.
 
Background:
 
On July 20, 2004, the El Dorado County (County) Board approved and authorized the Chairman to sign the RIA for the Project.  The terms of the RIA stated the Developer, at his own cost and expense, would construct or cause to be constructed the highway improvements, including a traffic signal at Four Seasons Drive, in accordance with the plans, change orders and itemized costs estimate approved by Deputy Director of the Department, Warren R. Pesses.  The advanced project costs would be eligible for reimbursement from the County's traffic fee program pursuant to the Road Improvement Fee reimbursement guidelines.    
 
During construction of the Project, the Department of Transportation (Department) requested  K. Hovnanian Forecast Homes, Inc. (Developer) to extend and construct a Con-Span structure of approximately forty-four feet in length under White Rock Road to accommodate the addition of two future lanes.    This Additional Work and the related reimbursement items were included in Amendment 1 to the Road Improvement Agreement (RIA) for the Project and were approved on December 6, 2005.  
 
Reason for Recommendation:
 
The road improvements for the Project and the Additional Work have been substantially completed as of August 24, 2006, according to the plans, specifications and requirements of the aforementioned RIA, the Amendment I to the RIA,  the Conditions of Approval for the Euer Ranch Subdivision and the Carson Creek Specific Plan.  
 
The Performance Bond No. SU5007993 in the amount of $6,564,3365.00 is being reduced by $5,907,901.50 to $656,433.50, which is 10% of the bonded amount.  This amount guarantees against any defective work, labor done or defective materials furnished.  
 
The Laborer and Materialmens Bond No. SU5007993 for $3,282,167.50 guarantees payment to persons furnishing labor, materials or equipment.  
 
Action to be taken following Board approval:
 
1.  The Clerk of the Board will:
 
      a.  Reduce the Performance Bond No. SU5007993 to $656,433.50.
      b.  Hold Laborer and Materialmens Bond No. SU5007993 for $3,282,167.50
 
2.  The Department will request the Clerk of the Board release the Performance Bond after one year the the Laborer and Materialmens Bond after six months, if listed conditions are met.
