Fiscal Impact/Change to Net County Cost:  
The total funding for this agreement is $1,382,000 for the period of the contract (original $850,000 plus amendment $532,000).  There is no change to Net County Cost.
 
Services provided under this contract are mandated entitlements and the state is legally required to pay for them in accordance with established formulas.   Payment terms of the contract limit the vendor's rates to the Statewide Maximum Allowance (SMA) and provide that if the SMA is lowered, the vendor's rates shall be lowered.  Therefore, the Governor's recently proposed budget reductions do not impact the funding for this contract.
 
Background:
The Mental Health Department contracts out for specialty mental health services for children with the local vendors that provide such services (Summitview Child Treatment Center, Inc., Tahoe Youth and Family Services, New Morning and Sierra Child and Family Services).  Specific contract terms and amounts are established considering factors such as the expertise and capacity of each vendor.  
 
The Department has contracted with Summitview Child Treatment Center, Inc. to furnish licensed facilities, personnel and services necessary to provide specialty mental health services for children on an "as requested" basis for over five years.  The current contract with Summitview was approved by the Board on December 5, 2006 and expires on June 30, 2008.  Amendment I to clarify the scope of services and update billing rates was approved by the Board on July 3, 2007.
 
Reason for Recommendation:  
An amendment increasing the not to exceed amount of the Department's contract with Summitview is needed due to the increased presentation of unusually complex clinical cases referred to this vendor which require more staff time/clinical services than anticipated at the time the original contract was executed, as well as the capacity of this particular vendor to provide the volume of services needed.  Additionally, recent lawsuits against the state (such as Emily Q. v. Bonta) have resulted in an increase in the number of children eligible for Early Prevention. Screening, Diagnosis, and Treatment (EPSDT) services in California, producing increased caseloads for Counties, including in El Dorado.  
 
The contract amendment will allow the Department to continue providing the mental health services needed for emotionally disturbed youth in the County.  This agreement covers the period December 5, 2006 through June 30, 2008.
 
The Purchasing Agent concurs that the department's request is in compliance with Board of Supervisors Policy C-17, Sections 7.4.2, 7.5, and 7.10.  Because there are a limited number of vendors in the county that provide these services and the Mental Health Department has contracts with all of these vendors, competitive selection is not warranted. The County Purchasing Agent has reviewed the department's request to amend the contract with Summitview and concurs that the continued use of this contractor is appropriate in order to avoid an interruption of needed services provided to the clients of the Mental Health Department
