DISCUSSION / BACKGROUND

On or about December 17, 2024, the County of El Dorado (County) was served with a complaint filed by Operating Engineers Public and Miscellaneous Employees Health and Welfare Trust Fund (OE Health Trust) alleging that the County owed unpaid health insurance premiums for certain County employees participating in OE Health Trust health insurance plans, dating back several years.  These employees were primarily members of the Corrections bargaining unit, represented by Operating Engineers Local Union No. 3 (OE3). The parties have recently reached settlement of this litigation. One of the terms of the settlement was that the County and OE3 would meet and confer in good faith to revise language in the Corrections Memorandum of Understanding that may have contributed to the accounting issues. 

 

The County and OE3, representing employees in the CR Bargaining Unit, executed a Memorandum of Understanding (MOU) for the period July 1, 2026 through June 30, 2028.  This MOU was executed before the parties could complete meet and confer obligations over the language covered by the settlement agreement.

 

The County and OE3 have now completed the meet and confer process required by the settlement agreement, and have negotiated a Letter of Agreement (LOA) updating the Employee Benefits and Retirement, Medical/Dental provision of the existing MOU. The LOA shall become of full force and effect upon approval and adoption by the Board of Supervisors.
