Recorder-Clerk recommending Resolutions implementing new fees of an additional $1 to be used for implementation and ongoing operation of a Social Security Number Truncation Program and  direct cost of regulation and oversight of Electronic Recording by the Attorney General, pursuant to Government Codes 27361(d)(1) and 27397(c)(1). 
RECOMMENDED ACTION:  Adopt Resolutions 307-2007 and 308-2007.

Fiscal Impact/Change to Net County Cost: No cost to County at this time.  Adoption of the resolutions will result in increased revenue to purchase software for implementation of new laws.
 
Background: Assembly Bill 1168, Chapter 627, addresses truncation of Social Security Numbers and creation of a "Public"  redacted record and an "Official" unredacted record and provides for a $1.00 fee for the first page of each instrument paper or notice recorded. Assembly Bill 578 Chapter 621, allows the Board of Supervisors to implement a fee of up to $1.00 for each instrument that is recorded to pay the direct cost of the oversight and regulation of the Electronic Recording System (ERDS) by the Attorney General.
 
Reason for Recommendation:  If not approved the Recorder-Clerk will not have funding to implement the statutorily required programs.
 
Action to be taken following Board approval:  Per each resolution Auditor/Controller will open either a Trust Account or a Special Revenue Fund (to be determined prior to implementation).  Thirty days following approval the Recorder-Clerk will begin collecting the fees and deposit to the appropriate account.  Assembly Bill 1168 Chapter 627 requires the Auditor/Controller perform two reviews that will be available to the public.  The reviews are to be conducted between 6/1/2012 and 12/31/2012, and between 6/1/2017 and 12/31/2017.
