Fiscal Impact/Change to Net County Cost:  There is no increase in net County cost.  The approved FY 2007-08 Development Services budget includes $100,000 in funding for this agreement.  The remainder will be covered through departmental savings.
 
Background:
 
Housing Element Law §65588 requires each local government to review and revise its housing element as appropriate, but not less than every five years.  The schedule for the upcoming revision of jurisdiction within the Sacramento Area Council of Governments, which includes El Dorado County, is set forth in §65588(e)(4).  The evaluation is required to include the assessment of current housing goals, objectives, and policies in contributing to the attainment of the state housing goals; the effectiveness of the housing element in attainment of the community's housing goals and objectives; and the county's progress in implementation of the housing element.  The revision shall address the findings of the evaluation of the current housing element.  Each revision is required to be reviewed and certified by the State Housing and Community Development Department for consistency with State Housing Law.
 
Pursuant to State housing element law (Government Code Section 65584 - 65584.01), the State Department of Housing and Community Development (HCD) is required to provide regional Council of Governments its determination of the region's existing and projected housing needs for the pending planning period.  This is called the Regional Housing Needs Allocation (RHNA) and is an important part of the Housing Element update.  Final adoption of the RHNA allocation for the Region and El Dorado County is anticipated in January/February 2008.
 
Key elements of the agreement include an evaluation of the 2003-2008 Housing Element, a revised housing needs analysis, preparation of a list of options for resources and opportunities, identification of constraints to the development of housing, revision of the County's housing goals, policies and objectives, ensuring consistency with other elements of the General Plan, and the development of an implementation strategy for programs and tasks outlined in the element.  The Consultant will also work with County staff in completing the required State review and certification process.
 
The Development Services Department has requested a contract with Conexus, a Limited Partnership, for the provision of review, evaluation, and preparation services of the County's current Housing Element.  The Procurement and Contracts Division has processed the subject agreement.  The agreement becomes effective upon execution and is set to expire June 30, 2009 with a not to exceed amount of $117,040.  
 
The Procurement and Contracts Division issued a Request for Proposal to solicit outside firms to perform the requested services; however, responses received were not favorable to the department's needs.  Development Services negotiated the contract terms with Conexus.
 
The Purchasing Agent has coordinated the outside review of the consultant's qualifications to perform the needed services with Joyce Aldrich, Program Manager, Human Services Department - Community Services Division.   Ms. Aldrich concurs that Conexus has demonstrated its ability to perform the work based on prior experience in the update of other jurisdiction Housing Elements, qualifications of the consultant, and the availability of the consultant to perform the services required of the department.  
 
The Purchasing Agent has determined that it is appropriate to dispense with any additional competitive selection processes for services performed by Conexus as the department has confirmed that this consultant is the most qualified, skilled, able, and competent to perform the work.  The Purchasing Agent concurs that the department's request is in compliance with Board of Supervisors Policy C-17, Sections 7.5 and 7.10.
 
Reason for Recommendation:  Housing Element Law §65588 requires each local government to review and revise its housing element as appropriate, but not less than every five years.  This agreement provides for the review and evaluation of the 2003-2008 Housing Element and assistance to County staff in completing the required State review and certification process.
 
Action to be taken following Board approval:  Board Chair to sign Agreement #471-S0811.  Board Clerk's Office will forward the executed agreement to Development Services for distribution.
