DISCUSSION / BACKGROUND

On September 19, 2017 (Legistar file 16-0416), the Board accepted the conditional award authorized under Senate Bill 844 Adult Local Criminal Justice Facilities Construction financing program for the Placerville Rehabilitation and Re-Entry Jail Expansion project.

 

On October 16, 2018 (Legistar file 18-1632), the Board approved the use of the Design-Build construction project delivery method for the Jail Expansion Project.

 

On September 12, 2023 (Legistar file 23-1640), the Board approved Agreement 8055 with Roebbelen Contracting, Inc. for the design-build services related to the Jail Expansion.

 

On September 24, 2024 (Legistar file 24-1605), the Board approved the 95% complete Plans & Specifications for the Jail Expansion Phase One Design Package (Civil Design) and authorized the Facilities Division Manager to approve the remaining 5% of the Plans & Specifications.

 

The project consists of the construction of a new approximately 23,025 square foot, two-story Jail Re-Entry facility adjacent to the existing Main County Jail in Placerville. The project will include site grading, utility extensions, and hardscape improvements, an approximately 620 square foot covered exterior exercise yard, and a 1,079 square foot canopy structure connecting the new Jail Re-Entry Facility to the existing Main Jail Facility.

 

The Division seeks approval regarding the 95% complete Plans & Specifications for the Placerville Jail Expansion Phase Two Building Plans and delegation of authority to the Facilities Division Manager to approve the remaining 5% of the Plans & Specifications for the same in advance of construction.

 

While there is no requirement under the Public Contracts Code for the Board to approve the Plans & Specifications for purposes of bidding out design-build construction projects, it is necessary in order for the County to avail itself of the design immunity defense under Government Code section 830.6. In summary, under Government Code 830.6, public entities are immune from liability for dangerous conditions on public property if those conditions arise because of improvement projects for which the plan or design was reasonably adopted or approved. 

 

ALTERNATIVES

The Board could decline to approve the Plans & Specifications for the Placerville Jail Expansion Phase Two Building Plans. If the Board chooses not to approve, the protections under Government Code section 830.6 will not be fully recognized.
