Fiscal Impact/Change to Net County Cost: The LEA receives funding from two revenue streams, a grant from the California Integrated Waste Management Board (CIWMB) of approximately $18,200 and solid waste franchise fees collected by Environmental Management.
 
Background: El Dorado County is mandated by the State to have a Local Enforcement Agency (LEA) to oversee the enforcement of solid waste laws in the County. Public Health assumed responsibility for the LEA in 1995 from the Building Department. While the LEA is normally placed in county environmental health departments, El Dorado County must place it elsewhere due to Environmental Managements operation of Union Mine Landfill, which is viewed as a potential conflict of interest.  State law requires the County to staff the LEA with a full time environmental health specialist. This requirement can be met by contracting with a neighboring jurisdiction possessing full time staff with expertise in solid waste management.  
 
Reason for Recommendation: Since July 1996, El Dorado County LEA field services have been contracted to Placer County, a certified Local Enforcement Agency, which employs full-time staff with expertise in solid waste management.  This arrangement has been both economical for El Dorado County and successful in meeting the goals of the LEA.  The attached contract will continue the provision of services by Placer County for another full year.
 
The contract is retroactive to July 1, 2007 due to an unexpectedly lengthy review process between El Dorado County and Placer County.  The Department sent documents to Placer County for signature on July 3rd and received them back on September 24th.  Staff moved as quickly as possible to have them ready for Board review and approval thereafter.  
 
Action to be taken following Board approval: Chairman to sign three (3) originals of attached agreement; Board Clerk's Office to forward two (2) signed documents to Public Health; Public Health to distribute as appropriate.
