DISCUSSION / BACKGROUND

The Final Map for the Summer Brook project (TM 07-1440-R-2) was approved by the Board of Supervisors on October 11, 2022 (Legistar File 22-1717). Concurrently with that map, the Board approved the Offsite Road Improvement Agreement for Green Valley Road at Deer Valley Road, Agmt #22-55006 (RIA), between the County and the Developer, Summerbrook, El Dorado, LLC (Developer).

 

On September 26, 2023 (Legistar File 23-1699), the Board approved a revision to the Project’s Conditions of Approval (COAs) to replace the requirement for a traffic signal at Green Valley Road and Deer Valley Road with a requirement to install intersection lighting. Per the staff report for that action, “an updated traffic report prepared in 2022 determined that population growth and densities utilized in the earlier Traffic Demand Model (2007) were overstated, and concluded that a traffic signal is no longer warranted, and determined that the intersection is operating well within County standards and is projected to remain in compliance in future cumulative conditions.” As a result of this modification, the RIA was amended on that same item to reflect the changes to the project’s Conditions of Approval and extend the performance period. The RIA was amended again on September 30, 2025 (Legistar File 25-1563) to further extend the performance period.

 

Per the revised COAs approved in September 2023, Condition of Approval #25 for the Summer Brook project reads as follows (changes from the original Condition are included here as strikeouts for removals and underlines for additions):

 

“The applicant shall signalize construct street lighting to illuminate the Green Valley/ Deer Valley Road intersection to meet current El Dorado County Standards, as required in the approved traffic study. These required enhancements improvements shall include street lighting with the use of cobra head LED figures in accordance with County Standards and the provision of electrical power to the light standards. Subdivider shall provide a funding source (e.g., inclusion in the project’s Home Owners Association [HOA] budget) to cover the cost of electricity and general maintenance of the equipment. geometric improvements to Green Valley Road consistent with the approved improvements plans for CIP Project No. 66114 which includes the intersection widening to provide for right and left tum channelization and acceleration/deceleration lanes and shall adhere to the latest version of the Manual Uniform Traffic Control Devices (MUTCD), the California Supplement, and the Caltrans Highway Design Manual. The improvements shall be substantially completed to the approval of the Department of Transportation or the applicant shall obtain a revised Improvement Agreement with security reflecting the changes above an approved improvement agreement with security, prior to the filing the final map.”

 

The required improvements have been completed per the Condition of Approval under the RIA, and the facilities are operational. Prior to accepting the work under the RIA as complete, the County has determined that a maintenance agreement is needed to define the scope of the maintenance required, as well as to memorialize the funding mechanism required by the Condition of Approval.

 

Transportation seeks to enter into Agreement #25-55102 (“Agreement”), with Summerbrook, El Dorado, Inc. (“Developer”) and the Oakhaven Homeowners Association (“Association”). This Agreement concerns the maintenance and operation of intersection lighting at Green Valley Road and Deer Valley Road. The County will perform routine maintenance of the intersection lighting, including but not limited to monthly and annual inspections as well as repairs or the replacement of components when needed, which shall be invoiced to the Association as appropriate. The Agreement shall remain in effect until either the intersection is signalized, upon mutual written consent of the parties, or for cause.

FINANCIAL IMPACT

There is no fiscal impact to the County as a result of this agreement. The Association is responsible for all maintenance costs outlined in the agreement; any work performed by the County to maintain the facilities will be recovered via a non-road fund billing process. In the event that the intersection lighting is converted to a signal in the future, per the terms of the Agreement the Association would no longer be responsible for the operations and maintenance costs and the County would bear the cost of installing and maintaining any signal equipment.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) The Clerk of the Board will obtain the Chair’s signature on two (2) original copies of the Agreement.

2) The Clerk of the Board will forward one (1) fully executed original copy of the Agreement to the Department of Transportation, attention Lindsay Tallman, for further processing.
