2) Delegate authority to the Environmental Management Department Director, to execute the Grant Agreement and all grant-related documents including, but not limited to, amendments, that do not require a County match, contingent upon approval by County Counsel and Risk Management, requests for payment, reports, and all associated documents necessary to secure grant funds and implement the approved grant program.

DISCUSSION / BACKGROUND

The Department of Resources Recycling and Recovery (CalRecycle) offers the SB 1383 Local Assistance Grant Program pursuant to Chapter 395, Statutes of 2016. This non-competitive grant program will provide one-time funding to local jurisdictions to assist with the implementation of regulation requirements associated with SB 1383 (Attachment B).

 

Grantees may incur eligible costs only during the Grant Term, which starts on the date CalRecycle sends the award email and ends September 2, 2024. All grant expenditures must be for activities, products, and costs specifically included in the approved Budget. Costs must be incurred after the term start date. All services must be provided, and goods received during this period, in order to be eligible costs (Attachment B). The grantee must also comply with all the stated Terms and Conditions of the grant (Attachment D).

 

On January 20, 2022, Environmental Management submitted an application to CalRecycle requesting OWR1 Grant Program funds in the amount of $212,284 (Attachment E).

 

On April 24, 2023, the County received a notification letter that County received a funding award of $212,198 (Attachment F).

 

In accordance with the eligible activities and costs stipulated in the OWR3 Grant Program, and in order to achieve the goals established for the SB 1383 Local Assistance Grant Program, Environmental Management intends to use the awarded funds to deploy education programs, cover administrative costs, potentially purchase a vehicle for inspections, and acquire software for tracking data as provided in the proposed budget submitted in the application (Attachment E).

 

In accordance with Board of Supervisors Policy A-6, the Board is the sole authority for accepting grant awards and approving grant agreements. After acceptance of a grant award and approval of the grant agreement, the Board may elect to delegate authority to execute the grant agreement and other grant-related documents.

 

The recommended acceptance of these OWR3 Grant Program funds authorizes the Environmental Management Director, to execute the Grant Agreement and all reports and associated documents necessary to secure and expend the funds for the purpose of implementing this OWR3 Grant Program. Environmental Management will continue to obtain Board approval for acceptance of all grant and payment program funds pursuant to Board Policy A-6.

 

ALTERNATIVES

The Board could reject the acceptance of these OWR3 Grant Program funds. This would result in the forfeiture of available OWR3 Grant Program funds awarded to the County and would further inhibit Environmental Management’s ability to contribute to come into compliance with SB 1383.

FINANCIAL IMPACT

There is no change to Net County Cost associated with this item. Approval of this item would increase funding in the amount of $212,198 towards County efforts to meet the State’s SB 1383 requirements and will be housed in Solid Waste. No matching funds are required for this OWR3 Grant Program. These Grant Program funds will be included in the Fiscal Year 2023-24 budget at adopted budget and will be included in future years’ budgets as applicable.
