District Attorney's Office recommending the Board:
1) Make findings that it is appropriate to engage an independent contractor to provide as-needed in-person or virtual science-based interviewing and interrogation technique training services, as Agreement 7930 requires specialty skills and qualifications not expressly identified in County classifications in accordance with County ordinance code 3.13.030(B); and
2) Approve and authorize the Chair to execute Amendment III to Agreement 7930 with Tailored Training Programs, LLC to extend the term by two additional years, through September 18, 2028, increase the amount by $125,000, resulting in the updated amount of $520,000, and amend the fee schedule included in Amended Exhibit A.

DISCUSSION / BACKGROUND
On September 19, 2023, with Legistar file 23-1448, Agreement 7930 was executed with Tailored Training Programs, LLC (TTP) in the original amount of $84,600 for as-needed training courses, on the matter of Science-Based Interview (SBI) Techniques. TTP is a consulting team comprised of world-renowned law enforcement interview instructors and has administered several successful trainings to the District Attorney’s Office in the past. TTP instructors are experts in the field of investigations and interview techniques. SBI utilizes scientifically supported interview techniques that prohibit both lying and coercion in interviews, maximizing information gathering, and avoiding false confessions and false information. These trainings allow District Attorney staff, as well as other law enforcement agencies, to increase their current level of interviewing and interrogation skills through the attendance of specially designed courses.
On April 30, 2024, with Legistar file 24-0625, Amendment I to Agreement 7930 was executed, increasing the amount by $190,400, updating the total agreement amount to $275,000. The additional funds were added for continued Science-Based Interviewing Technique trainings.
On April 1, 2025, with Legistar file 25-0393, Amendment II to Agreement 7930 was executed, increasing the amount by $120,000, updating the total agreement amount to $395,000. The additional funds were added for continued Science-Based Interviewing Technique trainings.
Proposed Amendment III to Agreement 7930 will extend the term by two additional years, through September 18, 2028, resulting in a revised total term of five years; increase the agreement amount by $125,000, for a new total of $520,000; and update the fee schedule within Amended Exhibit A. The increased amount will allow for continued additional training.
County Procurement Policy Section 3.5 describes exemptions to the competitive bidding process. Agreement 7930 falls under Exemption “Training Seminars/classes,” Findings of Fact “Vendors offer training seminars on subjects of interest at specific dates, time and locations. Consultants who conduct on-site classes are selected on the basis of competency in a specific subject on timely needs.” The services provided are as-needed in-person or virtual science-based interviewing and interrogation technique training services and fall under the exemption for training seminars/classes.
ALTERNATIVES
Should the Board opt not to approve Amendment III to Agreement 7930, extending the term through September 18, 2028 and increasing the amount to $520,000, the District Attorney’s Office will not be able to host their annual Science-Based Interview Training Symposium for 2026.

FINANCIAL IMPACT
There is no change to Net County Cost with the approval of Amendment III to Agreement 7930. The District Attorney’s Office plans to utilize Equitable Sharing Funds (EQSHR) to offset these SBI training service costs.
