DISCUSSION / BACKGROUND

A request has been submitted by Sandip Gupta and Meenakshi Rathke, Trustees of the Gupta and Rathke Family Trust, dated November 4, 2021, owners of Assessor's Parcel Number 120-680-011, requesting that the County of El Dorado, Board of Supervisors, vacate the Southwesterly 10’ of the Drainage, Sewer, and Public Utility easements, and the entirety of said Parking easement encumbering the northeastern portion of said property. The easements are more particularly described in Exhibit A and depicted on Exhibit B of the attached Resolution.

 

The Drainage, Parking, Sewer and Public Utility easements, as shown on Lot “A” of Ridgeview West Unit No.2, recorded in Book J of Subdivisions at Page 6, were offered to the County of El Dorado by Ridgeview West, L.L.C., A California Limited Liability Company, by Robert H. Becker, Managing Member, on September 12, 2002.  The easements were acknowledged by the County of El Dorado on June 10, 2003, and the Subdivision Map was recorded on June 11, 2003. Said easements are also shown on a secondary Subdivision Map, recorded in Book J, Page 55. Upon recordation of said resolution, the termination of the subject easements will also apply to said Subdivision Map.

 

Department of Transportation, AT&T, Comcast, El Dorado Irrigation District, Ridgeview West HOA, and Pacific Gas & Electric have not used said portions of subject easements for the purposes for which they were dedicated and find no present or future need exists for said portions of subject easements and do not object to their vacation, and to that end, have all issued letters to that effect.

FINANCIAL IMPACT

The Surveyor’s Office collects a fee for processing the Abandonment of Easement on a time and materials basis.  There is no fiscal impact as a result of the approval of this item.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) Clerk of the Board to obtain the Chair's signature on the one (1) Resolution.

2) Clerk of the Board to record the Resolution at the Recorder’s Office.

3) Clerk of the Board to return a copy of the recorded Resolution for further processing to the Surveyor's Office, Attn: Carter Meyers.
