Background:

The U.S. Hwy. 50/Missouri Flat Road Interchange Project #71317 Phase 1B, requires Fee title to a portion and a Public Utility Easement be acquired from the subject property owners in order to accomodate the widening of the Weber Creek Bridge (Veterans Memorial Bridge) on U.S. Hwy. 50 just east of the Missouri Flat Road Interchange and to construct the new eastbound on-ramp from Missouri Flat Road onto U.S. Hwy. 50.  The subject property consists of a single family residence and is located at 3643 Wamego Road, Placerville.

On December 12, 2006, your Board authorized DOT's Right of Way Unit to engage in negotiations to acquire portions of the subject property.  Negotiations with Mr. and Mrs. Katona have concluded and a settlement reached that is representative of the appraised value offered to the property owners for these land rights.

Reason for Recommendation:

The land rights are necessary from the subject property owners in order to widen the Weber Creek Bridge (Veteran's Memorial Bridge) and construct the new eastbound on-ramp from Missouri Flat Road onto U.S. Hwy. 50.

Action to be taken following Board approval:

1.                     Chairman of the Board to execute the Acquisition Agreement For Public Purposes and the Certificates of Acceptance for the fee and public utility easement.

2.                     Board Clerk to return all executed documents to the DOT R/W Unit for final processing.

3.                     Director of Transportation or designee to sign the escrow instructions and any related escrow documents pertaining to the transaction, including authorization for and payment to the subject property owners and title company.
