Fiscal Impact/Change to Net County Cost:
Acquisition costs are $30,000 for full compensation for the loss of landscape improvements and $1,900 for the temporary construction easement plus title and escrow fees of $1,000, for a total estimated cost of $32,900.  The Green Valley Road at Tennessee Creek - Bridge Replacement Project #77109, is funded with Highway Bridge Program (HBP), Highway Safety Improvement Program (HSIP) Grants and the 2004 GP Traffic Impact Mitigation Fee program (TIM) and sufficient funds are in the project budget for the subject acquisitions.  There is no net cost to the County General Fund associated with this agenda item.
 
Background:
The Department of Transportation (DOT) has been working to advance this grant funded project for the improvement, signalization, and channelization of the 3-way intersection of Green Valley Road and North Shingle Road and replacing the two-lane, reinforced concrete girder bridge with a three-lane, prestressed slab bridge.  Green Valley Road will be realigned to improve site distance and a continuous left turn median will extend from the North Shingle Road intersection past Peaceful Garden Way and transition into the northbound lane prior to Oakvale Drive.
 
The project is subject to California Environmental Quality Act (CEQA) and the National Environmental Policy Act (NEPA). The preparation of a CEQA Mitigated Negative Declaration and a NEPA Categorical Exemption has been completed and on December 9, 2008, your Board adopted and approved the project as described in CEQA and NEPA documents.
 
Reason for Recommendation:
On January 27, 2009, your Board authorized DOT's Right of Way unit staff to proceed with final negotiations to acquire land rights from the subject property owners.  Negotiations with Mr. and Mrs. Freeman have concluded and a settlement has been reached that is representative of the appraised value of the necessary land rights plus compensation for the loss of landscape improvements.
 
Action to be taken following Board approval:
1. Board Chair to execute the Easement Acquisition Agreement for Public Purposes and the Certificate of Acceptance for the temporary construction easement.
2. Board Clerk to return all executed documents to the DOT R/W unit for final processing.
3. Director of Transportation or designee to sign the Escrow Instructions and any related escrow documents pertaining to this transaction.  All executed documents and all funds necessary to close the escrow, to be provided to the title company for final audit and recording.
