Fiscal Impact/Change to Net County Cost:
 
There is no direct fiscal impact associated with this Agreement.  Federal funding for individual projects is addressed in Program Supplements that are issued in accordance with the Master Agreement.  Not executing this Agreement would cause current federal transportation funding to be disencumbered and/or deobligated and the County would not be permitted to participate in any future federally funded transportation programs.  
 
Reason for Recommendation:
 
The Department of Transportation is recommending approval and execution of this Agreement to assist the County in meeting its goal of delivering Capital Improvement Projects utilizing federal funds made available through the Federal Highway Act for transportation programs.  Before federal transportation funds will be made available for a specific program project, Administering Agency (County) and State (Caltrans) are required to enter into an agreement to establish the terms and conditions applicable to the County when receiving federal funds for a designated Project facility and to subsequent operation and maintenance of that completed facility.
 
This Master Agreement applies County wide and includes, but not limited to, the following federally funded transportation programs: Surface Transportation Program (STP), Congestion Mitigation and Air Quality Improvement Program (CMAQ), Transportation Enhancement Program (TE), Highway Safety Improvement Program (HSIP), and Highway Bridge Program (HBP).  The Department is taking the lead on this Agreement due to the significant number of federally funded transportation projects it manages.   
 
Pursuant to the El Dorado County Charter, section 210b (6), the County may enter into any contract or agreement in cases where the Agreement is with or among any other governmental entities or agencies.
 
In accordance with the Feasibility Analysis, the Department is not required to notify an employees' association regarding this Agreement.
 
 
Action to be taken following Board approval:
 
1. The Board Chairman will sign two originals of Master Agreement: Administering Agency - State Agreement for Federal-Aid Projects No. 03-5925R (County AGMT 06-1342).
 
2. The Board Clerk will forward two originals of the executed Agreement to the Department to send to Caltrans for their review, approval, and signature.
 
3. A fully executed original Agreement will be returned to the Board Clerk for filing.
 
4. The Department of Transportation will provide a copy of the fully executed Agreement to General Services for compliance with terms related to federally funded transportation related projects, such as bike paths, which are implemented by their department.
 
5. The Department will submit, for Board consideration, a resolution which continues to delegate authority to the Director of Transportation to accept and sign program supplements to the subject Master Agreement.
