DISCUSSION / BACKGROUND

Subdivision Map Amendments are required to be reviewed and approved by the original hearing body. The subject parcel was created by Subdivision Map E-072B (Attachment B, Exhibit F), recorded on September 30, 1970 after the final map was approved on September 29, 1969. The recorded map-imposed easements on the parcel (Lot 166), including a 25-foot Setback Line adjacent to Crystal Air Drive and a 12.5-foot Setback Line adjacent to Coto Street. The setback is described as “The front twenty-five (25) feet of all lots as a building setback and public utility easement for poles, guy wires, anchors, overhead and underground wires and conduits, including the right to trim and remove trees, tree limbs, and brush from the front ten (10) feet of the lot.”

 

The applicant is requesting an amendment to the recorded map to reduce the 25-foot setback to 0 (zero) feet for the purpose of egress to the site and building a two-car garage. The 5-foot snow storage easement located within the 25-foot Setback will not be affected. A variance to the 20-foot front setback, required in the Single-unit Residential zoning section of the current Zoning Ordinance, was granted by the Zoning Administrator on August 16, 2023 (File No. 23-1474, Item No. 1).

 

In order to approve the Subdivision Map Amendment, the County must find that the amended map complies with the Government Code and make specific findings pursuant to Section 120.72.040 of the County’s Subdivision Ordinance. Staff found that these findings could be made to show that this project adheres to and is within the standards as set forth. These and the applicable General Plan findings are presented in the staff report.  

 

Staff has reviewed the Subdivision Map for compliance with the tentative map conditions of approval and noted that all of the applicable conditions have been satisfied (Attachment D). Affected agencies/departments, including the El Dorado County Surveyor’s Office, El Dorado County Department of Transportation, Lake Valley Fire Protection District, Liberty Utilities, South Tahoe Public Utility District, have reviewed, verified compliance with the conditions, and recommended approval of the amended setback line. The Department of Transportation and the Surveyors office reviewed the project and had comments that have been incorporated into the Conditions of Approval.  No other agencies provided comments, conditions, or concerns therefore determining the original setback is no longer necessary.

 

Improvement Agreements and Bonds: No improvement agreements or bonds have been proposed or agreed to.

 

Water/Wastewater: The South Tahoe Public Utility District will provide service upon payment of the required service fee.

 

Environmental Review: The review of the Subdivision Map Amendment is a discretionary process and is Categorically Exempt from environmental review under Section 15305 of the CEQA Guidelines.

ALTERNATIVES

The Board may elect to approve the Subdivision Amendment with changes to the Conditions of Approval, or deny the application. A denial action may need to be continued to a date certain so that staff may prepare Finding for Denial.

The subject parcel was created by Subdivision Map E-072B recorded on September 30, 1970 after the final map was approved on September 29, 1969.

FINANCIAL IMPACT

There is no financial impact to the County. The Property owner will fund the recorded Subdivision Map Amendment.

This process is a departmental collaboration between the Planning and Building Department and the Surveyors Office to review and amend recorded Subdivision Maps.
