Department of Transportation recommending the Board:
1) Authorize the Chair to sign the retroactive Emergency Land Use Agreement 1291S82K4095, FENIX 5967, with the United States Forest Service accepting funds with a not-to-exceed amount of $25,000 for the use of one acre of land at the Maintenance Yard located at 2441 Headington during the Caldor Fire; and
2) Delegate signature authority to the Director of Department of Transportation to sign any additional Land Use Agreements or Facility Use Agreements for 2441 Headington Road with the United States Forest Service or CalFire during the Caldor Fire with a not-to-exceed amount of $65,000.

DISCUSSION / BACKGROUND
The Department of Transportation, Maintenance and Operations (Transportation) was contacted by CalFire on August 18, 2021, regarding the potential use of one acre of land at 2441 Headington Road, Placerville, CA 95667. On August 18, 2021, the Maintenance staff met with CalFire at the Fairgrounds and provided all the necessary information for the agreement. Likewise, Maintenance staff completed a walkthrough with CalFire personnel and took photos documenting the Maintenance Yard condition. Ultimately, it was determined to move forward, allowing CalFire and other fire personnel to use the location for ground support services. The evening of August 18, 2021, fire personnel began moving in equipment and using the Maintenance yard for ground support.
On Monday, August 23, 2021, CalFire finance staff visited the Maintenance Yard and completed additional paperwork since it had been determined the agreement would be with the United States Forest Service due to unified command. The United States Forest Service has authorized $200 per day for the use of the land. There is also the potential of an additional Land Use Agreement or Facility Use Agreement allowing fire equipment to use the wash rack located at 2441 Headington Road during the demobilization process. Should Transportation be approached for the use of the wash rack again, it is requested signature authority be delegated to the Director of Department of Transportation for any additional Land Use Agreement or Facility Use Agreement at 2441 Headington Road during the Caldor Fire.
A budget transfer will be brought back to the Board for approval to increase appropriations in the Maintenance budget once the final revenue amount has been determined.
ALTERNATIVES
The Board could choose not to sign the agreement; however this would be detrimental to Caldor Fire operations.

FINANCIAL IMPACT
There is no negative impact to the Fiscal Year 2021-22 budget.
CLERK OF THE BOARD FOLLOW UP ACTIONS
1) The Clerk of the Board will obtain the Chair's signature on two (2) originals of the Land Use Agreement.
2) The Clerk of the Board will return one (1) original of the Land Use Agreement to Department of Transportation, Maintenance and Operations, Attn: Ashley Johnson, for further processing.
