DISCUSSION / BACKGROUND
In April 2024, the Planning and Building Department, Tahoe Planning and Building Division, (Department) entered into Agreement 24C00051 with TRPA to assist with Phase 1 of the development of the Meyers Aquatic Invasive Species Station (Project) in Meyers. Following execution of the Agreement, the Department contracted with a qualified consultant to assist with completion of the Phase 1 deliverables including development of a thirty percent (30%) project design, an environmental document phase including a TRPA Initial Environmental Checklist (IEC), a California Environmental Quality Act (CEQA) Mitigated Negative Declaration (MND), a National Environmental Policy Act (NEPA) Environmental Assessment/Finding of No Significant Impact (EA/FONSI), and a public engagement process.
The Project is proposed on four (4) California Tahoe Conservancy (Conservancy) asset land parcels near the junction of State Route 89 and U.S. Highway 50, currently identified by the following Assessor’s Parcel Numbers (APNs): 034-300-028, 034-300-027, 034-300-026, and 034-300-025. The asset lands are zoned as Recreation, pursuant to the Meyers Area Plan; however, the Conservancy is unable to own property with the purpose of development in the area where the Project is proposed. As such, it has been determined that a land exchange between the County and the Conservancy is the most feasible solution. To initiate the process, the Department has included a line item for TRPA to reimburse the County for a small contract with a land appraisal company.
The Department and TRPA desire to amend the Agreement to increase the current budget of $474,726 by $195,000 for a revised not-to-exceed amount of $669,726 (replacing Exhibit B - Compensation with Amended Exhibit B - Amended Compensation), and extend the current expiration date of June 30, 2026, by eighteen (18) months for a revised expiration date of December 31, 2027. The proposed budget increase will allow for the appraisal services, a contingency, as well as more intensive project management services than originally anticipated due to the complexity of the Project. The extended term accommodates a brief service delay caused by a freeze in federal funds - being used by TRPA to fund the Project - and allows for the completion of the additional necessary services, while also building in time for potential unforeseen delays.
ALTERNATIVES
If the Board chooses not to approve the proposed Amendment, the Department and TRPA will be unable to proceed with the project management services and property appraisals, effectively halting progress on Phase 1 of the Project. The Department and TRPA would have to navigate alternative solutions, and current progress on the Project would be lost.
PRIOR BOARD ACTION
On April 9, 2025 (Legistar file 24-0326), the Board approved and authorized the Chair to sign Agreement 24C00051 with TRPA, allowing the Department to provide project management services for Phase 1 of the Project, with an not-to-exceed of $389,400, and a termination date of December 31, 2025.
On June 25, 2024 (Legistar file 24-1013), the Board approved and authorized the Chair to sign Amendment 1 to Agreement 24C00051, increasing the budget by $85,326 for a revised not-to-exceed of $474,726, and extending the term of the Agreement by six (6) months for a revised termination date of June 30, 2026.
On June 25, 2025 (Legistar file 24-1011), the Board approved and authorized the Chair to sign Agreement 8821 with Nichols Consulting Engineers, CHTD., to assist the Department and TRPA with Phase 1 of the Project, with a not-to-exceed of $399,486, and a termination date of June 18, 2026.

FINANCIAL IMPACT
There is no change to Net County Cost associated with this Amendment. TRPA will reimburse the Department for appraisal services and project management services (staff time at billable rates). Expected revenues and expenses have been incorporated into the Department’s budget for Fiscal Year 2025-26.
