DISCUSSION / BACKGROUND

A request has been submitted by JonPaul DeCarney and Nicole Marie DeCarney, husband and wife, owners of Assessor Parcel Number 071-370-036, requesting that the County of El Dorado, Board of Supervisors, vacate the entirety of the 200’ non building setback easement encumbering said property.The easement is more particularly described in Exhibit A and depicted on Exhibit B of the attached Resolution.

 

The 200’ non building setback easement, as shown on Parcel 1 of Parcel Maps Book 27 Page 125, was created by Robert Ellinghouse on October 8th, 1980. The easement was never acknowledged; therefore, it was neither rejected or accepted by the County of El Dorado, and the map recorded on October 8th, 1980.

 

The El Dorado County Planning Department has determined said 200’ non building setback easement was not used for the purpose for which it was dedicated and find no present or future need exists for that easement and do not object to its vacation, and to that end, have issued a letter to that effect.

FINANCIAL IMPACT

The Surveyor’s Office collects a fee for processing the Abandonment of Easement on a time and materials basis.  There is no fiscal impact as a result of the approval of this item.

 

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) Clerk of the Board to obtain the Chair's signature on the one (1) Resolution.

2) Clerk of the Board to record the Resolution at the Recorder’s Office.

3) Clerk of the Board to return a copy of the recorded Resolution for further processing to the Surveyor's Office, Attn: Carter Meyers.
