Health and Human Services Agency recommending the Board:
1) Approve and authorize the Chair to sign Amendment I to Agreement for Services 2088 with Infant Parent Center, for the provision of clinical services, outreach, linkage to other services, and stigma and discrimination reduction in support of Children age 0-5 and their families, with no change in the term of March 1, 2018 through June 30, 2020, and increasing the maximum obligation by $50,000 for a new total obligation of $625,000;
2) Make findings in accordance with County Ordinance 3.13.030 that it is more economical and feasible to contract with Infant Parent Center for services provided under this Agreement 2088 because the County has neither the qualified staff nor facilities to perform said services; and
3) Authorize the Purchasing Agent, or designee, to execute further documents relating to Agreement for Services 2088, including amendments which do not increase the maximum dollar amount or term of the Agreement, and contingent upon approval by County Counsel and Risk Management.
FUNDING: 100% State Funding: Mental Health Services Act.

DISCUSSION / BACKGROUND:
California voters passed Proposition 63 (MHSA), in November 2004 and MHSA was enacted into law January 1, 2005. MHSA imposes a one percent (1%) tax on personal income above $1,000,000. The funds are distributed to the counties throughout the State and are intended to transform the mental health system into one that is focused on wellness, recovery, and resiliency.
Under MHSA, each county is required to develop a Three-Year Program and Expenditure Plan (Plan), followed by two subsequent years of Annual Updates to the original Plan. The purpose of the Annual Update is to review existing projects and to make deletions, modifications, or additions to the original Plan. Therefore, planning, implementing, and updating each Plan and Annual Update is an ongoing, annual process.
On June 20, 2017, the Board adopted and authorized implementation of the MHSA FY 2017-2018 through FY 2019-20 Three-Year Program and Expenditure Plan (File 17-0551, Item 33). On June 25, 2019, the Board adopted and authorized implementation of the MHSA FY 2019-20 Annual Update (File 19-0936, Item 44).
One component of the Plan is Prevention and Early Intervention; and one project of that component is “Children 0-5 and Their Families.” Its objective is to provide early intervention by addressing the needs of young children who may be experiencing symptoms related to adjustment disorder, oppositional defiance disorder, and other childhood emotional disorders. The Board approved an agreement with Infant Parent Center on February 13, 2018 (File ID: 18-0038, Item # 12) to provide those services; and the MHSA FY 2019-20 Annual Update identified that the project will continue without any changes, with the exception of an increase to the maximum obligation. This Amendment will increase the maximum obligation to that Agreement to allow the “Children 0-5 and Their Families” project to continue through the end of the MHSA Three Year Plan expiring on June 30, 2020.
In accordance with Board of Supervisors Procurement Policy C-17, Section 7.11, the contractor selection process for service contracts in excess of $100,000 must include a review of the scope of services and contractor’s professional qualifications by a group of individuals (including at least one representative from outside the department requesting the services) qualified to judge the contractor’s ability to perform the services. HHSA has documentation on file that such a review was performed for Agreement 2088 with Infant Parent Center.
ALTERNATIVES:
Should the Board decline to approve this recommendation, HHSA would continue to provide services through existing contracts; however, the continuity of care for clients receiving services from this vendor may be disrupted.

FINANCIAL IMPACT:
There is no Net County Cost associated with this Agenda item. This Agreement for Services is funded by Mental Health Services Act funding. Sufficient appropriations were included in the fiscal year 2019-2020 budget, and will be included in future budgets for the term of the Agreement.
