RECOMMENDED ACTION:  Approve.
 
FUNDING:      Funding, Credit, and Reimbursement Agreement between West Valley, LLC and the County of El Dorado require that the developer of West Valley advance fund the construction of the Latrobe Road and White Rock Road Projects through the prepayment of El Dorado Hills Traffic Impact Mitigation (TIM) fees. A bond was issued and a portion of the proceeds were used to prepay $23 million in El Dorado Hills TIM fees. These prepaid fees are held in a segregated fund and will be utilized to fund the three Latrobe and White Rock Road construction projects listed above, including the requisite construction support.

Fiscal Impact/Change to Net County Cost:
All costs associated with the three Latrobe Road and White Rock Road projects have been advanced by the developer of the West Valley View project through prepayment of impact fees.  There are currently sufficient bond proceeds from the Community Facilities District No. 2005-1 (Blackstone) being held in a segregated fund for prepayment of fees in an amount in excess of the cost associated with the Agreement.
 
There is no net cost to the County General Fund associated with this agenda item.
 
Reason for Recommendation:
Dokken Engineering was used by the West Valley Subdivision developer to create the Plans, Specifications, and Estimate (PS&E) for the three Latrobe Road and White Rock Road projects under oversight by the Department of Transportation.  These improvements are known in the Capital Improvement Program (CIP) as the White Rock Road Realignment and Widening Project (CIP #72401), the Latrobe Road Widening Project (CIP #72402), and the Latrobe Road Realignment, Widening, and Bridge Project (CIP #72403).  Because support and oversight by the design engineer is necessary during the construction phase of a project, Dokken Engineering is uniquely qualified to provide this support.
 
In accordance with Board of Supervisors Policy C-17, Section 7.5 the Purchasing Agent concurs that it is appropriate to contract with Dokken Engineering as a sole provider for the needed services based on Dokken Engineering being the Engineer of Record for the three CIP Projects covered under this Agreement,
 
The Purchasing Agent has coordinated the review of the consultant's qualifications to perform the needed services with Randy Pesses, Public Works Director, City of Placerville.  The Purchasing Agent concurs that Dokken Engineering has demonstrated its ability to perform the work based on prior experience with this consultant, qualifications of the consultant's personnel assigned, and the availability of the consultant to perform the services.
 
The County Purchasing Agent has reviewed the Department's request to contract with Dokken Engineering and concurs that the use of this contractor is appropriate and that the Department's request is in compliance with Board of Supervisors Policy C-17, Sections 7.5 and 7.10.
 
The Department is recommending that the Board make findings pursuant to Article II, Section 210b(6) of the El Dorado County Charter that, although some of the necessary skills for the work to be performed under this Agreement are included in County job classifications, there are additional unique knowledge and specialty skills also required that are not expressly identified in County classifications.
 
The El Dorado County Employees Association, Local #1, has been informed of this proposed Agreement.
 
Action to be taken following Board approval:
1)      The Board Chairman will sign the two originals of Agreement for Services #07-1492 with Dokken Engineering; and
 
2)      The Board Clerk will forward one original of the fully executed Agreement to the Department  for further processing.
