DISCUSSION / BACKGROUND

Clean Tahoe began servicing the Lake Tahoe area in 1988 and began receiving a portion of Zone C parcel fees assessed on County Tax roll CSA 10 in exchange for solid waste diversion service by 1989. Clean Tahoe has been receiving approximately $29,000 annually from these taxes from El Dorado County.

 

In CSA 10, Zone C a $6 per Equivalent Dwelling Unit (EDU) parcel tax is collected. 50% of the tax ($3/EDU) funds the Clean Tahoe Program agreement, and the remaining 50% ($3/EDU) funds South Lake Tahoe Solid Waste program activities such as the Integrated Waste Management Plan (AB 939), State mandated solid waste diversion initiatives, administering solid waste contracts and franchise agreements, implements and enforces the Construction and Demolition Debris Ordinance, Bear Proof Garbage Can Requirement Ordinance, and Solid Waste Management Ordinance activities.

 

Since 1988, the agreement with the Clean Tahoe Program has remained at the same amount. The conceptual approval is to draft a new agreement that will provide for the   pass through of the entire amount of the tax collected minus an administrative fee that the Auditor Controller charges to administer the tax. The average collection of taxes after the Auditors fee is $53,378. The scope of the agreement will also be updated to reflect current operations of Clean Tahoe.

 

With the proposed agreement, Environmental Management will use Solid Waste fund balance to backfill the current $3/EDU from the parcel tax collected for the County’s activities with the Integrated Waste Management Plan, State mandated solid waste diversions, franchise agreements and other County Ordinances relating to solid waste.

 

The agreement terms will be for, April 1, 2025 - September 30, 2027, to align with the program's fiscal year (October 1- September 30) and provide staff time to work on a ballot initiative if necessary to increase the Zone of Benefit C parcel tax.

 

Lastly, the Board approved $29,000 in Discretionary Transient Occupancy Tax funds for the program in Fiscal Year 2023-24. These funds will be provided as a lump sum for a future capital purchase, with specific usage and reporting requirements to be fulfilled by the end of the new agreement's term.

 

ALTERNATIVES

The Board could not provide conceptual approval and provide direction to staff with changes.

FINANCIAL IMPACT

Approval of this amendment will not affect the Department’s Net County Cost. The full $6/EDU parcel tax collected (minus the Auditor’s fee) will fund the proposed Clean Tahoe Program agreement, while the Solid Waste fund balance will cover other required activities within CSA 10, Zone C, as provided by the County.
