DISCUSSION / BACKGROUND

On November 12, 2025 (Legistar file 25-0825), the Planning Commission held a public hearing to consider a request for a Conditional Use Permit (CUP23-0007) for the construction and operation of a new ARCO AM/PM project consisting of a 3,349-square-foot convenience store, a 100-foot-long automatic car wash, a 4,606-square-foot fuel canopy with six (6) fuel islands and twelve (12) fueling positions, and three (3) underground storage tanks, on property identified by Assessor’s Parcel Numbers 109-080-012 and 109-080-013, consisting of 3.69 acres, in the Shingle Springs area.

 

The Planning Commission approved CUP23-0007 with a vote of three (3) ayes and two (2) noes. Timely filed on November 24, 2025, the appellant seeks to reverse the Planning Commission’s approval of CUP23-0007 (Attachment A).

 

Staff’s response to the appeal and conclusion is detailed in a Staff Memo attached as Attachment B.

 

ALTERNATIVES

Reverse the Planning Commission’s approval of Durock Road AM/PM Conditional Use Permit CUP23-0007 (approve appeal CUP-A25-0003) with Findings of Denial based upon the Board of Supervisors direction.

FINANCIAL IMPACT

An appeal fee of $494 was collected for processing the appeal, CUP-A25-0003; however, staff costs associated with this appeal exceed the collected fees.  Approval of the project would allow for construction and operation of an Arco AM/PM convenience store, fueling station, and car wash resulting in additional property tax and sales tax revenues for the County.  According the El Dorado County Sales Tax Update (Q4 2024), available on the Auditor-Controller's website, Fuel and Service Stations account for the second highest sales tax generators within the County and Arco AM PM is identified as a top 25 sales tax producer.
