DEPARTMENT RECOMMENDATION

Community Development Services, Department of Transportation (Transportation), recommending the Board consider the following:

1) Accept the State of California Proposition 1 Storm Water Grant award in the amount of $150,000 and approve Grant Agreement D1612624 with the State Water Quality Control Board (State Water Board) for the Oflyng Water Quality Project, CIP 95177 (Oflyng Project/Project);

2) Authorize the Transportation Director to sign the Grant Agreement D1612624; and

3) Authorize the Transportation Director to execute any future amendments or modifications that do not increase the awarded Grant amount of $150,000.

 

DISCUSSION / BACKGROUND

The Board approved Resolution 176-2016 on October 25, 2016 (Item 22), indicating its support for Transportation's planning grant application to the State under the State’s Proposition 1, Water Quality, Supply, and Infrastructure Improvement Act of 2014 (2014 Water Bond).  The 2014 Water Bond allocates funds for multibenefit ecosystem and watershed protection and restoration projects.  Transportation’s application successfully competed with other public agencies, federally-recognized Native American tribes, and eligible nonprofit agencies and was recommended for award by State Water Board staff and its application review team.  The Grant funds will enable Transportation to complete the planning phase of the Oflyng Project, which includes planning documents, environmental certification, final plans, specifications, and an engineer’s cost estimate.

 

The Oflyng Project site is within an existing residential development located in the community of Meyers in South Lake Tahoe, bordered by Skyline Drive to the north, Pioneer Trail to the south, Elks Club Drive to the east, and Southern Pines Drive to the west.  The proposed Project will improve water quality by promoting infiltration, including open bottom conveyance structures and perforated conveyance pipes; low impact development improvements for both pretreatment and treatment of storm water runoff; and source control measures such as slope protection, curb and gutter, and armored channels to minimize active erosion, as well as capturing of materials from winter sanding operations.  The proposed improvements will reduce the discharge of sediment and pollutants to Lake Tahoe from County administered rights-of-way in the Project area.  The Project will not change the use of the site or surrounding area.

 

During the term of the Grant Agreement, Transportation anticipates the need to request that the State Water Board further modify the terms of the Grant Agreement, generally related to administrative issues, project schedules, and budgets.  Transportation is requesting that the Board delegate authority to the Transportation Director to execute these types of amendments or modifications provided they do not increase the awarded $150,000 value of the Grant.  If a future amendment or modification proposes to increase the amount of the Grant Agreement, Transportation will bring it to the Board for consideration.

 

ALTERNATIVES

The Board could choose to not approve the award and accept the Grant funds, and not authorize the Transportation Director’s signature on the Grant Agreement.  Transportation would then be unable to move forward with the Project until alternative funding is secured.

 

OTHER DEPARTMENT / AGENCY INVOLVEMENT

County Counsel has reviewed and approved the Grant Agreement documents.

 

CAO RECOMMENDATION

It is recommended that the Board approve this item.

 

FINANCIAL IMPACT

There is no impact to Net County Cost associated with this item.  Approval of the proposed Grant Agreement will allow Transportation to receive $150,000 in State 2014 Water Bond revenue through the State Water Board, which has been programmed as part of the 2016 Capital Improvement Program.  The total Project costs of $868,000 will be funded by Tahoe Regional Planning Agency mitigation funds and future grant funds from the California Tahoe Conservancy and United States Forest Service.
