Title: Surveyor's Office recommending the Board adopt and authorize the Chair to sign the following Resolutions for Abandonment of Easements, as requested by property owners Kayvan Haddadan and Sara Niyati, Trustees of The Kayvan Haddadan and Sara Niyati Family Trust at property identified as Assessor's Parcel Number 110-312-030 located at 1036 Columbia Circle within the community of El Dorado Hills, Supervisorial District 1: 1) Resolution 166-2023 for Abandonment of Easement No. 2022-0010 to abandon portions of a strip of land, 10 feet in width, within Parcel 1 of Parcel Map recorded in Book 46 of Parcel Maps, at Page 44, El Dorado County Records, said Easement described on said map as “Public Utility Easement”; and 2) Resolution 167-2023 for Abandonment of Easement 22-0010, to abandon portions of Public Utility easements on Lots 158 and 157 of The Summit Unit No. 2, recorded in Book H of Subdivisions at Page 26. Surveyor's Office recommending the Board adopt and authorize the Chair to sign the following Resolutions for Abandonment of Easements, as requested by property owners Kayvan Haddadan and Sara Niyati, Trustees of The Kayvan Haddadan and Sara Niyati Family Trust at property identified as Assessor's Parcel Number 110-312-030 located at 1036 Columbia Circle within the community of El Dorado Hills, Supervisorial District 1:

1) Resolution 166-2023 for Abandonment of Easement No. 2022-0010 to abandon portions of a strip of land, 10 feet in width, within Parcel 1 of Parcel Map recorded in Book 46 of Parcel Maps, at Page 44, El Dorado County Records, said Easement described on said map as “Public Utility Easement”; and

2) Resolution 167-2023 for Abandonment of Easement 22-0010, to abandon portions of Public Utility easements on Lots 158 and 157 of The Summit Unit No. 2, recorded in Book H of Subdivisions at Page 26.

DISCUSSION / BACKGROUND

A strip of land, 10 feet in width, within Parcel 1 of the Parcel Map was recorded in Book 46 of Parcel Maps, at Page 44, El Dorado County Records, said Easement described on said map as “Public Utility Easement” was illustrated by Summit II, LTD., A California Limited Partnership; By GB Summit II, A California General Partnership, Its Partner, on Parcel Map Book 46 Page 44. Said Public Utility Easement was shown on said Parcel Map which recorded on June 16, 1997.

 

Public Utility Easements, as shown on Lots 158 and 157 of The Summit Unit No. 2, recorded in Book H of Subdivisions at Page 26, were offered to the County of El Dorado by Southfork Partnership a General Partnership; Home Capital Corporation a California Corporation, General Partner, on April 11,1990.  The easements were acknowledged by the County of El Dorado on June 5, 1990, and the Subdivision Map was recorded on July 9,1990.

 

A request has been submitted by Kayvan Haddadan and Sara Niyati, Trustees of The Kayvan Haddadan and Sara Niyati Family Trust, owners of APN 110-312-030, requesting that the County of El Dorado, vacate portions of the Public Utility easements located on said property. The portion of the easements to be abandoned is more particularly described in Exhibit A and depicted on Exhibit B of the attached Resolutions (Attachments A and B).

OTHER DEPARTMENT / AGENCY INVOLVEMENT

AT&T, Comcast, El Dorado Irrigation District and Pacific Gas & Electric have not used said Public Utility Easements for the purposes for which they were dedicated and find no present or future need exists and do not object to its vacation, and to that end, have provided approval letters to the County Surveyor’s Office.

 

CAO RECOMMENDATION / COMMENTS

Approve as recommended.

 

FINANCIAL IMPACT

The Surveyor’s Office collects a fee for processing the Abandonment of Easement on a time and materials basis.  There is no fiscal impact as a result of the approval of this item.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) Clerk of the Board to obtain the Chair's signature on the Resolutions.

2) Clerk of the Board to record the Resolutions at the Recorder’s Office.

3) Clerk of the Board to return a copy of the recorded Resolutions for further processing to the Surveyor's Office, Attn: Carter Meyers.
