Transportation Department recommending Chairman be authorized to sign Funding Agreement AGMT 08-1789 with property owners (DONORS) adjacent to the River Pines Estates Road Zone of Benefit to provide funding in addition to the annual benefit assessment in the amount of $7,000 for a road maintenance and repair project; and approve Budget Transfer increasing estimated revenue and expenditures in the amount $7,000 for said project. Fiscal Impact/Change to Net County Cost:
Upon approval by your Board, a budget transfer will be processed making the following adjustment to the River Pines Estates Road Zone of Benefit budget for fiscal year 2008-09: 1) $7,000 will be added to budgeted revenues; 2) $7,000 will be added to expenditures to cover the cost of road maintenance work. There will be no other impact on the budget for the River Pines Estates Road Zone of Benefit.
Reason for Recommendation:
The donors under Funding Agreement #AGMT 08-1789 own property outside of the boundaries of the River Pines Estates Road Zone of Benefit and as such are not obligated to contribute to the maintenance and repair of roads within the Zone. However, these property owners use D'Agostini Drive, which is within zone of benefit boundaries, and wish to contribute funds for the repair of a specified segment of that road.
Property owners are not permitted to use private money to independently maintain and repair roads within a zone of benefit. For this reason, the property owners who wish to contribute to the maintenance of D'Agostini Drive are required to contribute the cost of the work to the zone of benefit and then contract through the County for the work in compliance with applicable laws and ordinances. The River Pines Estates Road Zone of Benefit has submitted a request for road maintenance work and a contract has been processed to perform the work during the latter part of this month. The existing contract will be amended to accomplish the additional work for which funding is provided under Funding Agreement #AGMT 08-1789. The Amendment will not be fully executed until the Funding Agreement is signed and the funds are deposited in the account for the River Pines Estates Road Zone of Benefit.
Action to be taken following Board approval:
The Board Chairman will sign two originals of Funding Agreement #AGMT 08-1789. The Board Clerk will forward two copies of the fully executed Agreement to the Department of Transportation for further processing. The Board Chairman will approve and sign the attached Budget Transfer.
