Fiscal Impact/Change to Net County Cost:
Upon approval by your Board, a budget transfer will be processed making the following adjustments to the Fernwood Cothrin Road Zone of Benefit budget for fiscal year 2006/2007:
$19,500.50 will be added to budgeted revenues; $18,230.50 will be added to budgeted expenditures for road maintenance to cover the cost of the road work; and $1,270 will be added to inter-fund expenditures to cover zone of benefit administration costs to process the contract and Funding Agreement.  Once the Funding Agreement is fully executed, the property owner, Frederick J. Simon, will provide the funds to be deposited in the Zone of Benefit account.
 
There is no additional cost to the Fernwood Cothrin Road Zone of Benefit, to the Department of Transportation Road Fund, or to the General Fund.
 
Background:
Your Board formed the Fernwood Cothrin Road Zone of Benefit on April 30, 1985 by Resolution 91-85 for the purpose of providing road improvement and maintenance services on all the roads within the zone boundaries. Assessor's Parcel Number 087-270-31 currently owned by Frederick J. Simon lies fully within the boundaries of the Fernwood Cothrin Zone of Benefit.  Mr. Simon has submitted a request to subdivide the twenty-acre parcel of land into two ten-acre parcels. As a condition of approval for Parcel Map 04-0003, Mr. Simon is required to make certain improvements to Bullard Drive, which is maintained through the Fernwood Cothrin Road Zone of Benefit and is considered to be a public road.
 
Reason for Recommendation:
Landowners are not permitted to use private money to independently improve zone roads.  Instead, the landowner is required to contribute the cost of the improvement to the zone of benefit which can then contract for the work in accordance with the competitive bidding laws and other County requirements. The Funding Agreement attached here for your approval will facilitate the deposit of funds necessary to complete the work on Bullard Drive required under the conditions of approval for Parcel Map 04-003.
 
The Department of Transportation has obtained approval of Contract PW 06-143 with Van's Paving and Grading to complete the work on Bullard Drive.  The Notice to Proceed for the work under the Contract will not be issued until the Funding Agreement is fully executed and the funds are deposited in the account for the Fernwood Cothrin Ranch Zone of Benefit.  It is anticipated that the project will be completed before June 30, 2007.
 
Action to be taken following Board approval:
1.      The Board Chairman will sign two originals of Funding Agreement #06-1228 with Frederick J. Simon.
 
2.      The Board Clerk will forward two copies of the fullly executed Agreement to the Department of Transportation for further processing.
 
3.      The Board Chairman will approve and sign the budget transfer attached.
