Health and Human Services Agency (HHSA) recommending the Board:
1) Authorize the HHSA Behavioral Health Director to sign Non-Financial MOU 5291 with California Correctional Health Care Services (CCHCS) Health Information Management (HIM) for the provision of electronic data sharing services provided under Agreement 5291 for a term of three (3) years effective upon final execution; and
2) Authorize the HHSA Behavioral Health Director to execute further documents relating to Agreement 5291, contingent upon approval by County Counsel, Risk Management, and IT, including amendments which do not increase the term of the MOU.

DISCUSSION / BACKGROUND:
The purpose of Non-Financial MOU 5291 with California Correctional Health Care Services (CCHCS) Health Information Management (HIM) is for the secure transfer of Personally Identifiable Information (PII)/Protected Health Information (PHI), and/or Health Insurance Portability and Accountability Act (HIPAA) data between California Correctional Health Care Services (CCHCS) Health Information Management (HIM) and Health and Human Services Agency (HHSA) via CCHCS secure file transfer portal (SFTP). CCHCS and HHSA will work collaboratively to facilitate the timely and efficient release of patient-inmate medical records between CCHCS HIM and HHSA for the purpose of ensuring continuity of care/coordination of care for medical, mental health, dental, and substance use disorder treatment. CCHCS and HHSA will work together to ensure secure transfer of PII/PHI and/or HIPAA.
Per Board Policy C-18 Non-Financial Agreements, the Chief Administrative Officer has the authority to sign MOU 5291, but CCHCS has requested that the individual designated as the Information Custodian on behalf of the County sign the MOU. HHSA is requesting the Board authorize the Behavioral Health Director to sign the MOU and applicable Exhibits to be signed by designated staff who will access the CCHCS SFTP. Forms to access the SFTP as well as forms related to privacy and security are required initially and annually as applicable. Delegating a single signatory will allow for a more streamlined and efficient process to ensure compliance with CCHCS and County network security protocols.
ALTERNATIVES:
Should the Board decline to approve this MOU, HHSA would continue to receive patient-inmate medical records in a format that would be less secure than the CCHCS SFTP.
