Title

Planning and Building Department, Planning Division, Long Range Planning Unit, recommending the Board approve and authorize the Chair to sign a memorandum of understanding (MOU) between the County and the El Dorado County Water Agency (EDCWA) for EDCWA’s contribution of $50,000 towards the County’s General Plan Safety Element Update Project.

DISCUSSION / BACKGROUND

On May 14, 2019 (File No. 19-0600, Item No. 33.), the Board adopted Resolution of Intention 068-2019 to amend the County’s General Plan Safety Element in accordance with various requirements under Government Code section 65302 (g)(3) and 65302 (g)(4), as well as Assembly Bill 2140 and Senate Bill 379.

 

In March 2020, the Planning and Building Department (Department) issued a Request for Proposals (RFP) for consultant services to update its General Plan Safety Element Update Project (Project) as required by state law. Following the RFP process, the Department selected Wood Environment & Infrastructure Solutions, Inc. (Wood Environment) and began negotiating an agreement for this Project. During the contract development process, staff also worked with EDCWA to review the scope of work for the Project.

 

On March 16, 2021 (File No. 21-0288, Item No. 19), the Board approved Agreement 5185 with Wood Environment to complete this Project, with a not-to-exceed amount of $215,142 and a term of three (3) years. Wood Environment began working on the Project shortly thereafter; however, due to unforeseen delays surrounding COVID, significant progress was not made on the Project during Fiscal Year 2020-21 and it was determined that it would be best to account for EDCWA’s funding contribution during Fiscal Year 2021-22 when more progress could be made and costs incurred. As such, EDCWA agreed to carry that funding contribution forward, which was approved by EDCWA’s Board of Directors on September 8, 2021.

 

The Department has prepared the attached MOU in order to receive this one-time funding from EDCWA.

 

ALTERNATIVES

The Board may choose not to approve the proposed MOU and subsequent funding contribution from EDCWA. This would not result in an impact to the overall Project; however, it would require an additional General Fund contribution of $50,000.

County Counsel has approved the proposed MOU.

CAO RECOMMENDATION / COMMENTS

Approve as recommended.

 

FINANCIAL IMPACT

There is no change to Net County Cost associated with the approval of the proposed MOU. The anticipated $50,000 contribution is included in the Fiscal Year 2021-22 budget.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) The Clerk of the Board will obtain the Chair’s signature on two (2) original copies of the MOU; and

2) The Clerk of the Board will forward one (1) fully-executed copy of the MOU to the Planning and Building Department, attention Tom Meyer, for further processing.

 

STRATEGIC PLAN COMPONENT

Good Governance: Promote the development of resources to identify and pursue additional revenue including local, state, federal, and private funding for new and existing projects.

 

Public Safety: The updated Safety Element will improve communication and coordination on public safety goals and objectives between the County departments and divisions, outside agencies, and the public.
