DISCUSSION / BACKGROUND

On June 11, 2025, Operating Engineers Local No. 3 (Union) representing employees in the Trades and Crafts (TC) Bargaining Unit, filed an Unfair Practice Charge with the California Public Employment Relations Board regarding County actions pertaining to reductions in force authorized by the Board of Supervisors on June 10, 2025 (Legistar file 25-0948). The County and the Union, on behalf of employees in the TC unit (collectively, the Parties), subsequently executed a Memorandum of Understanding (MOU) for the period through June 30, 2026. However, the Unfair Practice Charge remained pending.

 

In an effort to resolve the matter, the Parties have negotiated a Letter of Agreement (LOA) updating the Procedure for Permanent Layoffs provision of the existing MOU. The LOA shall become of full force and effect upon approval and adoption by the Board of Supervisors.

 

ALTERNATIVES

As adoption of the Resolution and negotiated Letter of Agreement resolves the Unfair Practice Charge, there are no recommended alternatives.

06/10/2025 Legistar file 25-0948: Board authorized the Human Resources Department to initiate and process a reduction in force.

 

02/03/2026 Legistar file 26-0208: Board adopted the most recent MOU for this bargaining unit.
