Sheriff's Office recommending the Board:
1) Adopt and authorize the Chair to sign Resolution 015-2020 approving the acceptance of grant funds from the California State Parks, Off Highway Vehicle (OHV) Division Grant Program in the amount of $98,690 for law enforcement services on the Rubicon Trail and OHV areas within El Dorado County;
2) Approve and authorize the Sheriff to sign the Off-Highway Vehicle (OHV) Grant Project Agreement G18-03-07-L01 in the amount of $98,690 with the California Department of Parks and Recreation for the term September 6, 2019 through September 5, 2020; and
3) Approve the attached budget transfer increasing use of Sacramento Municipal Utility District Upper American River Project Federal Energy Regulatory Commission Special Revenue monies from $102,137 to $121,310 for an increase of $19,173 to cover costs associated with patrolling Federal Land. (4/5 vote required)

DISCUSSION / BACKGROUND
The Sheriff's Office has received this grant funding since 2001. This funding has allowed Sheriff's law enforcement to address and mitigate several issues on the Rubicon Trail over the years. For a period of time, the Rubicon Trail was not a family friendly environment; however, due to increased law enforcement presence, users have noticed a positive change in the environment and culture, and the Trail is once again a safe place for families to enjoy.
The grant funding is used to fund a portion of a sergeant position as well as two deputies’ salaries and benefits. Grant funding is also used to purchase equipment and supplies to support law enforcement services on the Rubicon Trail and OHV areas within El Dorado County.
The initial grant application request was for approximately $400,000.00 to fund the Sheriff’s Office OHV program, but the award amount is for $98,690.00. Acceptance of these grant funds requires a 25% match, for this grant cycle that amount would be approximately $33,000.00 for a total of approximately $132,000.00. However, this total does not cover the anticipated costs of the program, which are expected to be $220,000.00 since additional grant funding was not awarded. Rather than using general fund to cover the difference, the Sheriff’s Office is requesting additional funds from the El-Dorado Sacramento Municipal Utility District (SMUD) Cooperation Agreement funds to be used for patrolling Federal Land.
On December 18, 2012, the Board created a Special Revenue Fund for the El-Dorado Sacramento Municipal Utility District (SMUD) Cooperation Agreement funds. The funds were to be used to fund multiple programs on the Rubicon Trail for several County departments. The Sheriff's Office requested and received these funds to partially offset its Fiscal Year (FY) 2014/2015, FY 2015/2016, FY 2016/2017, FY 2017/18, FY 2018/19 and FY 2019/20 Rubicon patrol law enforcement activities costs.
ALTERNATIVES
Failure to include a resolution, submit the acceptance, and provide additional funding will result in the loss of grant funds for Rubicon patrol law enforcement activities.
