DISCUSSION / BACKGROUND
El Dorado County Department of Transportation (Transportation) completed construction of the Pioneer Trail III Erosion Control Project (Project) in 2001. For the Project, the Board authorized the execution of a License Agreement with the City of South Lake Tahoe (City) to allow Transportation to construct and maintain improvements on three City owned parcels (March 6, 2001, Item 17). The improvements constructed on these parcels were designed to meet Transportation's National Pollutant Discharge Elimination System (NPDES) Permit requirements and water quality objectives to improve Lake Tahoe's clarity. The existing agreement expired on March 6, 2021. Transportation has continued to meet its inspection and maintenance requirements on these parcels since the expiration of the previous agreement; however, both the City and Transportation wish to reestablish a formal relationship for this work under the proposed License Agreement. This renewal will be for an additional 20-year term.
ALTERNATIVES
The Board could choose not to approve the License Agreement. If not approved, the County could face difficulty maintaining County installed and previously maintained infrastructure on the City parcels.

County Counsel and City Counsel have reviewed and approved the License Agreement.

FINANCIAL IMPACT
There are no fees or assessments relative to this License Agreement. There is no fiscal impact or net cost to the County General Fund associated with this agenda item.
CLERK OF THE BOARD FOLLOW UP ACTIONS
1) The Clerk of the Board will obtain the Chair's signature on one (1) original copy of the License Agreement.
2) The Clerk of the Board will complete the All Purpose Notary Acknowledgement provided.
2) The Clerk of the Board will forward the original signed License Agreement and the All Purpose Notary Acknowledgement to John Kahling, Transportation, Headington Engineering.
TRANSPORTATION FOLLOW UP ACTIONS
Transportation will forward to the City of South Lake Tahoe for signature. Once signed, the County will record the License Agreement with the Recorder Clerk's office.
