Health Services Department, Mental Health Division, recommending the Board authorize the Chair to sign Amendment I to Agreement 231-S1111(087-105-M-E2010) with New Morning Youth and Family Services, Inc., modifying contract articles for Compensation and Notices to Parties, and updating Exhibit A, "Program Definitions and Service Requirements for Children's Services," to remove language pertaining to AB 3632 (repealed by the State), with no change to the term or not-to-exceed amount, for specialty mental health services for seriously emotionally disturbed minors on an "as-requested" basis for said Department.
FUNDING: Medi-Cal/Early and Periodic Screening, Diagnosis and Treatment (EPSDT), as well as Mental Health Realignment, as determined by the funding sources available and appropriate for each youth.

Fiscal Impact/Change to Net County Cost: There is no Net County Cost associated with this Amendment I. Amendment I does not modify the not-to-exceed amount of the original Agreement.
Compensation for Services: Payments are made to Contractor based upon monthly invoicing at specified billing rates for actual services performed and documented per contract requirements. Services and rates are detailed on page 4 of the contract.
Contract Termination: This Agreement includes the County's standard Fiscal Considerations termination language, as well as a provision for the County to terminate the Agreement without cause with seven (7) calendar days written notice.
Background: The original Agreement 231-S1111 was approved by the Board of Supervisors on December 14, 2010 via Board item 10-1248. Amendment I modifies the language in the Compensation article which allows the vendor to increase or decrease their rates with written notice to the HSD Director or designee. The final cost of services paid will be the lowest of the following:
· the vendor's published rate (on page 4 of the contract);
· the Statewide Maximum Allowable rate (set by the State);
· or the vendor's actual cost, which is determined after it has prepared its annual cost report.
Amendment I also updates the Notices article and updates Exhibit A, "Program Definitions and Service Requirements for Children's Services," to remove language pertaining to AB 3632, which has been repealed by the State.
Reason for Recommendation: This contract provides for specialty mental health services to youth served by New Morning. Specialty mental health services provided under this Agreement include assessments, case management, Therapeutic Behavioral Services, crisis intervention, as well as individual, group and family therapy. New Morning is a unique vendor in El Dorado County as it delivers services to students in County schools when needed.
The services requested by MHD from New Morning are intended to keep youth out of higher and far more expensive levels of care.
This Agreement covers the period January 1, 2011 through June 30, 2012.
Action to be taken following Board approval:
1. Chair to sign three (3) original Amendments.
2. Board Clerk's Office to return two (2) original Amendments to the Health Services Department, Mental Health Division.
3. Mental Health Division to distribute as appropriate.
