Health and Human Services Agency (HHSA) recommending the Board:
1) Make findings pursuant to Section 3.13.030 (B) of the El Dorado County Ordinance Chapter 3.13, Contracting Out, that Social Rehabilitation Treatment Services provided by Compassion Valley LLC (Compassion) requires specialty skills and qualifications not expressly identified in County classifications are involved in the performance of the work;
2) Make findings to waive the competitive bid process for Agreement for Services 8093 with Compassion in accordance with the County Procurement Policy C-17, Section 3.4.2(f), Exemption from Competitive Bidding, as the Compassion possesses critical knowledge, including the required staff, facilities, and level of care certifications and facility licenses, to ensure continuity of this mandated service;
3) Approve and authorize the Chair to sign Amendment II to Agreement for Services 8093 with Compassion to increase the contract value by $900,000, for a new total amount of $1,500,000, and update standard contact article language with no change to the term, expiring June 30, 2026;
4) Authorize the Purchasing Agent to execute amendments relating to Agreement 8093, contingent upon approval by County Counsel and Risk Management, which do not increase the maximum dollar amount or term of the Agreement; and
5) Authorize the HHSA Director, or the Chief Assistant Director, to execute programmatic, administrative, and fiscal documents relating to Agreement 8093.
FUNDING: Federal and State Funding: 36% Federal Medi-Cal, 54% Behavioral Health Realignment, 10% Mental Health Services Act.

DISCUSSION / BACKGROUND:
The HHSA Behavioral Health Division (BHD) acts as the El Dorado County Mental Health Plan (MHP) and is responsible for providing eligible residents with access to mental health services, including residential treatment, in accordance with California Welfare and Institutions Code (WIC) Sections 5600 et seq., 5775 et seq., 14000 et seq., and 17000 et seq. Social Rehabilitation Treatment Services (SRTS) facilitate the transition of eligible individuals from restricted to less restrictive, independent living environments. To meet this demand, HHSA contracts with facilities within and outside the County for Adult Residential Facility and SRTS placements.
Since 2021, the County has contracted with Compassion to provide SRTS to adults with serious mental illness who meet the criteria for Specialty Mental Health Services under WIC Section 14184.402. These services support BHD clients in developing skills for greater self-sufficiency and independence, ultimately aiming for community reintegration.
Agreement 8093 was approved by the Board on January 9, 2024 (Legistar file 23-2148). Amendment I, which updated provisions including Compensation for Services, Service Authorization, and standard contract articles, was approved by the Purchasing Agent on October 18, 2024.
This is an "as needed" contract where services are only rendered upon placements by BHD. The placements can depend on facilities providing the most appropriate services for the client as well as bed availability. This contract has seen an increase of use from the clinical teams as they assess the best placements of clients which has resulted in increased bed utilization. The larger not-to-exceed amount for the remainder of the term will accommodate HHSA’s increased need for SRTS beds. HHSA recommends approval of this Amendment II to ensure continuity of care for mandated SRTS services.
ALTERNATIVES:
Should the Board decline to approve this recommendation, HHSA will continue to provide SRTS services through existing contracts but would be limited in its access to these types of facilities in the local community. Subsequently, the County would have diminished capacity to provide services required of the MHP. Additionally, the continuity of care for County clients currently placed with Compassion would be disrupted.

FINANCIAL IMPACT:
There is no Net County Cost associated with this agenda item as funding is provided through state funded MHSA, Behavioral Health Realignment. and Federal funded Medi-Cal. Sufficient appropriations have been included in HHSA’s Fiscal Year 2024-25 Budget and will be included in future budgets for the term of the Agreement, as well as Medi-Cal reimbursement as appropriate.
