Fiscal Impact/Change to Net County Cost:The expected cost of providing services under the AB3632 program is $1,000,000. The program is funded with approximately $400,000 coming from Federal Medi-Cal and State EPSDT funding, $520,000 from SB90 funding, and the remaining $80,000 from Federal IDEA funding via this MOU. There is no Net County Cost.
 
Background: AB3632 of 1984 transferred the responsibility for providing mental health services for Special Education students from the schools to the counties. The cost of these services is partially funded by Federal Individuals with Disabilities Education Act (IDEA) funds (SB77) with the remaining portion funded through the SB90 mandated claims process. Because of Federal regulations, the funds must be routed through Education to County Mental Health Departments. AB1765 (Chapter 157, Statutes of 2003) provides for the transfer of these funds and requires an MOU between County Mental Health Department and County Office of Education.
 
Reason for Recommendation:This agreement will partially offset the cost of providing mental health services for Special Education students. This agreement is retroactive to July 1, 2006 because a signed version was not received from Office of Education until February, 2007. It then had to be routed through Purchasing, County Counsel and Risk Management and signed by the Mental Health Department.
 
Action to be taken following Board approval:Board Clerk's Office will forward the executed agreement to Mental Health for further processing.
