3) If there is no majority protest, adopt and authorize the Chair to sign Resolution 088-2026.

DISCUSSION / BACKGROUND
The Board formed the West Valley Village Zone of Benefit #98612 (Zone) on July 18, 2006, by Resolution 233-2006, in response to a petition to form the zone submitted by the developer to satisfy conditions of Tentative Map 99-1359 (TM99-1359). The purpose of the Zone is to provide road and drainage maintenance services for specific Collector Roads within the Zone boundaries. On October 26, 2004, the Board of Supervisors accepted the final large lot map for the West Valley Village subdivision (page 43 of Subdivision Maps Book J). A total of twenty-five (25) subsequent subdivision maps were approved by the Board between 2006 and 2018, as the various units were developed, the last of which was Unit 3C, approved on April 13, 2018 (page 17 of Subdivision Maps Book K).
On July 17, 2007, the Board revised the Zone's boundaries by Resolution 07-1113.
On July 25, 2023, the Board formed Community Facilities District (CFD) No. 2023-1 (East Ridge) by Resolution 117-2023 to fund the construction of certain major infrastructure improvements, and to pay certain impact fees associated with the East Ridge development project.
On December 2, 2025, the Board adopted Resolution 176-2025 to amend the special tax formula, authorizing the financing services and increasing the indebtedness limit for Community Facilities District No. 2023-1 (East Ridge CFD). The addition of services authorized to be financed by the CFD was primarily to facilitate the exit of the CFD property from the West Valley Village Zone of Benefit, as requested by the landowners.
Pursuant to Government Code §25217.2, the Board may revise the boundaries of a zone within any County Service Area (CSA) by complying with the same process used to form a zone of benefit. The Policy and Procedure Guidelines for Creation and Administration of Zones of Benefit Within a County Service Area, as amended September 10, 2024 (Guidelines), allow the Board to change the boundaries of a zone of benefit either by petition of the property owner(s) or Board-initiated proceedings when determined to be in the public interest to do so.
A complete application was submitted by the owners of the East Ridge Subdivision requesting the detachment of the parcels within the East Ridge Subdivision from the West Valley Village Zone of Benefit No. 98612 within CSA 9. County staff have validated the information contained in the application.
Today's Hearing was noticed in the Mountain Democrat, and 1,553 individual mailings were sent to parcel owners that will be directly affected by the boundary revision.
ALTERNATIVES
The Board may choose not to adopt the Resolution to revise the Zone boundaries; however, such action would conflict with the CFD Bonds previously approved.

FINANCIAL IMPACT
There is no impact to the General Fund nor change to Net County Costs. The costs associated with the proceeding are funded by the applicant.
