DISCUSSION / BACKGROUND
At the request of several Special Districts, the Board of Supervisors established development impact mitigation fees. The County manages the collection, holding, and distribution of these fees on behalf of the individual Districts. Since the Districts lack the authority to impose such fees independently, the Board voluntarily adopted them, taking on the responsibility of complying with the reporting requirements outlined in the Mitigation Fee Act ("Act").
Under the Act, the Board must issue annual reports and make specific findings every five years after the initial deposit of fees. The attached reports include the required annual report, as mandated by Section 66006 of the Act for all the Special Districts, which must be made public within 180 days after the end of each fiscal year. For Fiscal Year 2024-25, no five-year findings are due from any Districts.
Although this information has been posted on the County's webpage https://www.eldoradocounty.ca.gov/Land-Use/Planning-and-Building/Planning-Division/Planning-Fees/AB-1483-Reporting and is available at the office of the Clerk of the Board and the Placerville Library, the Act also requires the Board of Supervisors to schedule a public meeting at least 15 days after it has been made public to receive the reports.
ALTERNATIVES
The Board could choose not to receive the annual reports, which would cause the County to be non-compliant under Section 66001 of the Act.
