DISCUSSION / BACKGROUND

The Public Defender is recommending the Board approve and authorize the Purchasing Agent to sign Agreement 3055 with The Regents of the University of California acting on behalf of University of California, Davis Health in the amount of $11,600 with an effective date retroactive to May 4, 2018 through March 3, 2019 for the provision of expert witness consultation and testimony.   The total contract not to exceed amount is $11,600, including service fees, travel time, and reimbursement of approved direct expenses.

 

The retroactive nature of this Agreement was necessitated by the Department’s urgent need to engage with the expert witness for consultation and testimony in a very sensitive, active court case requiring pediatric psychological services.  Shortened time frames were dictated by the courts.  The agreement was sent to the vendor in May, and they indicated they had a 4 to 6 week approval process on their side.  Procurement and Contracts followed up on the status of the agreement once that time had passed, and it was determined that a red-lined copy had been returned to the Public Defender instead of Contracts.  Changes were then reviewed and implemented accordingly, and returned to the vendor for signatures.  The signed agreement was received back from the vendor in mid-August.

 

ALTERNATIVES

The services have already been provided due to the urgent nature of the case.  At this time, we are not aware of any other alternatives that would allow for work to continue as needed in this case.

FINANCIAL IMPACT
