Fiscal Impact/Change to Net County Cost:  No change.  The Agreement is funded by Federal and State dollars with required County match met primarily with realignment resources.  Funds were budgeted for FY 08-09 and 09-10, and will be budgeted for FY 10-11.
 
Reason for Recommendation:  The Department of Human Services (DHS) maintains agreements with multiple local vendors for the provision of various services for its clients to ensure that clients can be referred by their caseworker on an "as requested" basis to receive necessary services from the most appropriate and conveniently located vendor.  Choice of vendor is based on the specific needs of each individual DHS client.  Family  Connections El Dorado, Inc. provides therapeutic counseling, equine-assisted therapy, substance abuse treatment, anger management and other related services to DHS clients.  Equine-assisted therapy is a specialized service that is occasionally ordered by the Court for DHS clients and is available through Family Connections El Dorado.  Due to on-going financial constraints resulting from recent budget cuts, this vendor has agreed to reduce its rate for provision of equine-assisted therapy at the Drug Medi-Cal Reimbursement rate for standard therapy.  Article III, "Compensation" has been revised to reflect the reduction in the rate for equine-assisted therapy.  Article I, "Scope of Services", and Article XVI, "Notice to Parties" have been revised to reflect current contact information and addresses.  
 
The Purchasing Agent reviewed the Department's request to amend this Agreement versus a new contract and concurs that it is more appropriate to do an amendment versus a new contract. The Purchasing Agent has determined that it is appropriate to dispense with a competitive selection process in order to continue with services and because the amendment simply calls for a reduction in charges for equine-assisted therapy.  The outside reviewer concurs that the vendor is qualified and able to perform the services.  Outside review of the contractor's qualifications to perform the needed services was coordinated with Shirley White, Department of Health Services.  The Purchasing Agent concurs that the Department's request is in compliance with Board of Supervisors Policy C-17, Sections 7.5 and 7.10.  
 
Action to be taken following Board approval:
1.  Chairman to sign two (2) original Agreements
2.  Board Clerk to return one (1) original Agreement to the Department at 3057, Briw Road.  
3.  Department to distribute as appropriate.
