DISCUSSION / BACKGROUND
This Board item represents the first report of Road Improvement Agreements (RIAs) processed with delegated authority pursuant to Ordinance 5194. Ordinance 5194 delegates the authority to execute, amend, and accept as complete RIAs for projects in the County right-of-way that have a total cost estimate of up to $1,000,000. The Ordinance was approved on March 5, 2024 (Legistar File 23-1908) and went into effect on April 4, 2024.
Per the Board’s direction, Ordinance 5194 states, “The Director [of Transportation] shall provide a report to the Board annually on the Road Improvement Agreements executed under this authority in the previous fiscal year.” During Fiscal Year 2023/2024 and Fiscal Year 2024/2025, no new projects within the County right-of-way met the criteria for the delegated authority, and all actions related to RIAs were brought to the Board for their approval.
During Fiscal Year 2025/2026, the Department of Transportation (Transportation) utilized the delegated authority under Ordinance 5194 to execute one new RIA, as shown in the report included here as Attachment A. The report provides details of the RIA’s execution date, project name, estimated cost, and developer information, and copies of the executed agreement, its bonds, and its approvals are attached for reference.

FINANCIAL IMPACT
There is no fiscal impact or change to net County cost associated with this item. Costs related to each Road Improvement Agreement are borne by the respective developer, unless a reimbursement agreement is executed prior to beginning construction on a given project. No work under the agreement reported in this item is reimbursable.
