Planning and Building Department, Planning Division, recommending the Board approve and authorize the Chair to sign Amendment II to competitively procured Agreement 6834 with Michael Baker International, Inc., for the provision of services necessary to assist the County with as-needed land use planning and environmental reviews for various development projects, increasing the not-to-exceed amount by $320,000 for a revised not-to-exceed amount of $820,000, and extending the term by two (2) years for a revised expiration date of September 27, 2027.

DISCUSSION / BACKGROUND
The California Environmental Quality Act (CEQA) and County CEQA Resolution 61-87 allow the County to hire consultants, funded by project applicants/developers, to prepare complex and comprehensive CEQA documents such as Environmental Impact Reports.
On September 27. 2022 (Legistar file 22-1327), the Board approved Agreement 6834 with Michael Baker International, Inc. to assist Department with as-needed land use planning and environmental reviews for various development projects, with a not-to-exceed amount of $500,000, and a term of three (3) years.
On August 22, 2023, the County’s Purchasing Agent approved Amendment I to Agreement 6834 amending Article XVI, Notice to Parties; and adding Exhibit C, California Levine Act Statement with no changes to not-to-exceed amount or term of agreement.
MBI continues to assist the Planning and Building Department (Department) with processing several development projects, including Village of Marble Valley Specific Plan, Lime Rock Valley Specific Plan and Creekside Plaza projects. Additionally, there continues to be a need for supplemental staff assistance with current planning activities, including environmental review, community outreach, meeting facilitation, application processing and other land use entitlement services as new development proposals are processed by the County, which are services included in the proposed Agreement with MBI.
The increase to the not-to-exceed amount of $320,000 with a new not-to-exceed amount of $820,000 and extending the term of the contact by two (2) years for a revised expiration date of September 27, 2027 will allow MBI to continue to assist the Department to see the existing projects through completion and to absorb one or more additional projects during the revised timeframe.
ALTERNATIVES
The Board may choose not to approve the proposed Amendment. This would result in delays in completing other tasks and projects that staff are currently fully engaged on as those staff would have to absorb the additional work needed as new development projects are processed by the Department.

FINANCIAL IMPACT
There is no change to Net County Cost associated with this item as no costs are to be incurred by the County. All costs are paid by the Project applicants. Funding for these services has been included in the Department's Fiscal Year 2025-26 Budget. Funding for these services beyond Fiscal Year 2025-26 will be included in subsequent years’ budgets accordingly.
CLERK OF THE BOARD FOLLOW UP ACTIONS
1) The Clerk of the Board will obtain the Chair’s signature on two (2) original copies of the Amendment; and
2) The Clerk of the Board will forward one (1) fully-executed original Amendment to the Chief Administration Office, Procurement and Contracts Division, for further processing.
