Title

DISCUSSION / BACKGROUND:

In 2011, the Board authorized the County to become a participating member of the CalMHSA Joint Powers Authority (JPA) through Resolution 024-2011 (Legistar file 10-1324). In 2015, the County joined CalMHSA’s “State Hospital Bed Program,” which is designed to reduce administrative burden and improve coordination between California Department of State Hospitals (DSH) and participating counties (Legistar file 15-1386). Under this program, CalMHSA serves as the primary point of contact and lead negotiator for bed rates and utilization with the DSH. Per California Welfare and Institutions Code (WIC) Sections 4330 and 4331, counties are required to contract with DSH to access state hospital beds and are required to reimburse DSH for the use of those beds. County residents with serious mental illness who have not responded at lower levels of care may be referred to DSH for appropriate treatment in accordance with WIC Section 4100 et seq.

 

In December 2023, the Board approved Participation Agreement 8132 which reauthorized CalMHSA to negotiate with DSH for state hospital beds on behalf of the County (Legistar file 23-1852). In June 2025, the Board approved Amendment I to Agreement 8132, which extended the initial contract term by one year and increased the initial maximum obligation to accommodate the additional year (Legistar file 25-0484). This agreement is designed to ensure compliance with applicable legal requirements, improve efficiency, control costs, and maintain quality of care.

 

This proposed Amendment II to Participation Agreement 8132 will extend the County's participation for one year, ensuring continued access to inpatient psychiatric beds with DSH.

 

ALTERNATIVES:

Should the Board decline to approve this recommendation, HHSA may be out of compliance with WIC Sections 4330 and 4331 which require the County to contract with, and reimburse, DSH on an annual basis for inpatient psychiatric bed usage.

FINANCIAL IMPACT:

There is no General Fund Cost associated with this agenda item. Sufficient appropriations for this agreement were included in the Fiscal Year 2026-27 budget request.
