DISCUSSION / BACKGROUND

Five projects along Malcolm Dixon Road in El Dorado Hills were conditioned to construct several improvements in the projects’ vicinity to improve circulation for the new developments. These projects were Diamante Estates (TM06-1421), Malcolm Dixon Road Estates (TM05-1401-E), Alto LLC (TM06-1408), La Canada (TM08-1463), and Wilson Estates (TM14-1515) (collectively “Subdivision Projects”). Each of the Subdivision Projects included Conditions of Approval which required the widening and realignment of Malcolm Dixon Road, along with the completion of a “new connection” between Malcolm Dixon Road and Green Valley Road, now known as the Malcolm Dixon Cutoff. In service of those Conditions of Approval, Transportation seeks to accept the Malcolm Dixon Cutoff into the County’s Maintained Mileage System.

 

The underlying right of way for the Malcolm Dixon Cutoff was dedicated by Renasci Wilson Estates, LLC via the Final Map of Wilson Estates, TM14-1515, which was approved by the Board of Supervisors on August 16, 2016. Final Map J-148 was recorded on August 19, 2016, and it accepted the dedication “subject to improvement for public purposes.” The Wilson Estates project constructed the southern portion of the connection from Green Valley Road to the development’s entrance, and the remaining road north of the Wilson Estates driveway was constructed as a gated emergency access road without through access.

 

Prior to execution of the Final Maps for the four remaining Subdivision Projects, the County executed the Offsite Road Improvement Agreement for Malcolm Dixon Area of Benefit, TM05-1401-E, TM06-1408, TM06-1421-E, and TM08-1463 Between the County and the Developers (Agreement #19-54910, “RIA”). The original parties to the agreement included the owners of the Subdivision Projects: Omni Financial, LLC; Alto LLC; Salmon Falls Land and Cattle Company, LLC; Diamante Development, LLC; and the Christopher A. LaBarbera Revocable Trust, 2019. Salmon Falls Land and Cattle Company, LLC later lost the land underlying the La Canada project due to foreclosure; the project was acquired by La Canada 143-25, LLC, and the party was replaced in the RIA with the first amendment to the agreement. The RIA included the improvements to both Malcolm Dixon Road and the Malcolm Dixon Cutoff.

 

Malcolm Dixon Road was widened and realigned under the RIA, and additional right-of-way and easements were dedicated as needed. Malcolm Dixon Road is already included in the County’s Maintained Mileage System, and Transportation staff confirmed that the changes to the alignment have not altered the road length/stationing enough to require adjustments to the road in the County’s and State’s records.

 

The Malcolm Dixon Cutoff, however, is a new roadway segment. Per the Subdivision Projects’ Conditions of Approval, the roadway was designed to County standards and is to be County maintained upon completion.

 

Improvements under the RIA were substantially completed and accepted as complete on May 21, 2024, with a warranty period through May 21, 2025. The Malcolm Dixon Cutoff is secure and stable, no warranty repairs are anticipated based upon current site conditions, and the improvements are considered fully complete and eligible for inclusion in the Maintained Mileage System.

 

Transportation recommends that the Board approve the attached Resolution, thus accepting the Malcolm Dixon Cutoff into the El Dorado County Maintained Mileage System.

 

ALTERNATIVES

The Board could direct Transportation to add the road segment to the Maintained Mileage System after the conclusion of the warranty period. Delaying the addition would mean the road segment would not be eligible for Caltrans maintenance funding until the 2025 revisions are submitted in spring of 2026, as required under Streets and Highway Code Section 2121.

On August 16, 2016 (Legistar file 14-1331 v4), the Board approved the Final Map for Wilson Estates, TM14-1515, recorded at Book J of Subdivisions at Page 148.

 

On September 24, 2019 (Legistar file 19-1130 v2), the Board approved the Offsite Road Improvement Agreement for Malcolm Dixon Area of Benefit, TM05-1401-E, TM06-1408, TM06-1421-E, and TM08-1463 Between the County and the Developers, Agreement #19-54910. On July 18, 2023 (Legistar file 23-1244), the Board approved the First Amendment to the RIA. On May 21, 2024 (Legistar file 24-0805), the Board accepted the road improvements under the agreement as complete.

FINANCIAL IMPACT

Adding the Malcolm Dixon Cutoff to the County Maintained Mileage System will slightly increase State funding for road maintenance, based upon the addition of centerline mileage to the system. Any future maintenance of the roadway will be part of Transportation’s usual maintenance activities.
