Department of Transportation recommending the Board:
1) Receive and file an annual report on real property acquisitions executed by the Director of Transportation, under the authority of Ordinance 5181, for acquisitions totaling $42,046 during the reporting period of July 1, 2024, through June 30, 2025; and
2) Receive and file revised annual report on real property acquisitions previously reported for the reporting period of July 1, 2023, through June 30, 2024.
FUNDING: Local sources include Traffic Impact Fees, Road Fund, Tribe Funds, Tahoe Regional Planning Agency/ Water Quality, South Tahoe Public Utility District, and County Service Area 5. State/Federal sources include Regional Surface Transportation Program Funds, Highway Bridge Program Funds, United States Forest Service, and California Tahoe Conservancy.

DISCUSSION / BACKGROUND
This Board item represents the second annual report of real property acquisitions pursuant to Ordinance 5181. For this annual reporting period of July 1, 2024, through June 30, 2025, only real property acquisitions for approved Capital Improvement Program (CIP) and Environmental Improvement Program (EIP) projects have been executed. During this period, the Department of Transportation (Transportation) Right of Way Unit acquired five (5) individual acquisitions under Ordinance 5181 totaling $42,046, ranging from $4,900 to $12,000 per acquisition.
During the annual reporting period of July 1, 2023, through June 30, 2024, the Transportation Right of Way Unit acquired one (1) additional individual acquisition under Ordinance 5181 totaling $5,400. This acquisition was inadvertently omitted from the report to the Board on August 27, 2024 (Legistar file 24-1418) for Fiscal Year 23/24 but was signed by the Director during that year. It is included in this annual Fiscal Year 24/25 report.
The Annual Right-of-Way report presented to the Board for FY23/24 totaled $46,700; with this additional acquisition, the new total for FY23/24 is $52,100.

PRIOR BOARD ACTION
On August 22, 2023 (Legistar file 23-0801 v2), the Board approved Ordinance 5181, which requires an annual report to the Board of real property acquisitions. This ordinance became effective on September 21, 2023.
On August 27, 2024 (Legistar file 24-1418), the Board received the first annual report of real property acquisitions under Ordinance 5181.
OTHER DEPARTMENT / AGENCY INVOLVEMENT
Transportation staff work with County Counsel to facilitate acquisitions on an as-needed basis.

FINANCIAL IMPACT
There is no fiscal impact or net County cost associated with this item. These real property acquisitions were made using various funding sources as detailed in Transportation's CIP, and described in Attachment A.
