Department of Transportation recommending the Board:
1) Make findings in accordance with Section 3.13.030(C) of the County Ordinance, Contracting Out, for on-call materials testing services, that due to the temporary or occasional nature of the work, the ongoing aggregate of work to be performed is not sufficient to warrant the addition of permanent staff; and
2) Approve and authorize the Chair to sign Agreement for Services 8284 with Geocon Consultants, Inc. to provide on-call materials testing services in the not-to-exceed amount of $150,000 for a period beginning upon execution and expiring three years thereafter. (All Districts)

DISCUSSION / BACKGROUND
In September 2023, Department of Transportation (Transportation) issued a formal Request for Proposal (RFP) for on-call materials testing services. Transportation has a materials testing lab that can perform the majority of the testing needed for construction projects; however, there are some specialized tests that they cannot perform and must be sent out to a consultant. Three (3) proposals were received and evaluated, and Geocon Consultants, Inc. was selected as the most qualified firm.
Transportation recommends the Board make findings in accordance with Section 3.13.030(C) of the El Dorado County Ordinance that due to the temporary or occasional nature of the materials testing services that would be provided under the proposed agreement, hiring of additional staff to perform said services is not justified. County staff will be performing much of the work covered under the proposed agreement. The proposed agreement is necessary to provide testing services in unusual and infrequent situations where additional staff is needed or when County staff cannot perform testing due to atypical tests for which County staff is not certified or unique, specialized equipment being required to complete the testing.
The RFP process was conducted in accordance with County Procurement Policy C-17.
The El Dorado County Employees Association (Local #1) was informed of the proposed Agreement.
ALTERNATIVES
The Board could choose not to approve the agreement. Transportation would make changes as requested and return to the Board for approval.

FINANCIAL IMPACT
Funding for the Agreement will be provided by various CIP project funding sources, including federal, state, and local funds. The funding for this proposed agreement are budgeted and will be budgeted in future years. The services under the proposed agreement will be used on an as needed basis. The recommended action results in no change to net County cost.
CLERK OF THE BOARD FOLLOW UP ACTIONS
1) The Clerk of the Board will obtain the Chair’s signature on two (2) originals of the Agreements.
2) The Clerk of the Board will forward one (1) fully executed original of the Agreement to the Chief Administrative Office, Contracts and Procurement Unit, for further processing.
