DISCUSSION / BACKGROUND  

On June 18,2024 following a reported complaint from the El Dorado County Sheriff's Office regarding the condition of the property located at 3369 Patterson Way, El Dorado Hills (Property), Planning and Building Department, Code Enforcement Division (Code Enforcement) conducted an inspection and observed that the Property was a vacant building. At that time, the Property was secured; however, structural deficiencies and an unmaintained pool were noted. Due to the condition of the Property, Code Enforcement deemed the building vacant and in violation of County Ordinance Section 9.02.600 et seq., which states that no owner shall allow a building designed for human use or occupancy to be a vacant building without active maintenance for more than thirty (30) calendar days. Code Enforcement posted a Red Tag on the building, designating it a “Vacant Building.” After the Red Tag was posted, a Notice and Order was sent stating the requirements for monitoring and maintaining the Property in accordance with County Code Section 9.06.600 et seq.

 

On February 13,2025 Code Enforcement sent an updated Notice and Order to the Property owners for the vacant building violation, detailing that vacant building fines would be imposed if the Property was not brought into compliance (to prevent public access) by March 17, 2025. The Property owner did not respond to Code Enforcement’s notice or take any corrective actions; the mail was undeliverable.

 

On April 9, 2025, Code Enforcement issued and posted a Notice to Abate at the Property, notifying the Property owners of the vacant building violations and requiring abatement by May 9, 2025. The notice further advised that if the Property was not brought into compliance (to prevent public access) or abated (to obtain permits to repair violations) by the specified date, the County would proceed with abatement and assess all related costs to the Property owners. The Property owners did not respond or take any corrective action.

 

The Department continued sending statements to the Property owners and posting statements at the Property, the mail continued to be undeliverable.

 

On September 4, 2025, Code Enforcement returned to the Property to post a statement and observed that the building had been broken into again, resulting in additional structural damage and broken windows.

 

Code Enforcement continued to make attempts to contact the Property owners but did not receive a response. The Property was going through bankruptcy court during this time and, the mail continued to be undeliverable.

 

Solicitation for bids from abatement contractors came in much higher than anticipated, and the County Facilities division ultimately was selected to secure the property if necessary.

 

On October 8, 2025, Code Enforcement obtained an Abatement Warrant to board up the residence and secure the property. The Abatement Warrant was posted on the property.

 

From October 10, 2025, through October 13, 2025, the County boarded up and fenced off the vacant building in accordance with County Code Section 9.02.300. 

 

On October 21, 2025, Code Enforcement was notified by the Bankruptcy Trustee that the Property was being listed for sale. As of the date of the Board item, the property is still on the market and has not been sold.

 

Once the costs were obtained from all County departments involved in the property's abatement, the Department processed the resolution and Board item.

 

Approval of this Resolution will allow a lien to be placed on the Property for all outstanding fees.

 

ALTERNATIVES

The Board may choose not to adopt the Resolution allowing for a lien to be placed on the Property. This would result in a loss of revenue owed to Code Enforcement for abatement costs.

FINANCIAL IMPACT

Lien amounts collected will allow the County to recover costs incurred to remedy the Property of its violations. Code Enforcement maintains a Special Revenue Abatement Fund that is used to pay the up-front costs of abatement. Prior to the sale of the Property, the lien must be cured, and the funds received are placed back into the Abatement Fund.

 

CLERK OF THE BOARD FOLLOW UP ACTIONS

1) The Clerk of the Board will obtain the Chair’s signature on the Resolution;

2) The Clerk of the Board will have a certified copy of the Resolution recorded; and

3) The Clerk of the Board will provide a certified copy of the Resolution to Patricia Soto, Planning and Building Department, for further processing.
