DISCUSSION / BACKGROUND
On February 26, 2025, at the request of the Department of Transportation (Transportation), the Procurement and Contracts Division of the Chief Administrative Office issued a Request for Proposals (RFP) 24-0123 for as-needed real property appraisal, appraisal review, acquisition, and relocation services. Transportation evaluated the need for services based on upcoming projects in the Capital Improvement Program (CIP), including other projects as needed, and decided to issue four (4) as-needed agreements for services with the County. The RFP process was conducted in accordance with County Procurement Policy C-17.
A panel evaluated and ranked seven (7) proposals that were received based on understanding the scope of work, past performance, and related experience, qualifications of their team, technical ability, and knowledge of state and federal procedures for public right-of-way. One of the top-ranked proposers for services was Bender Rosenthal, Inc. (BRI), and on September 16, 2025, Legistar 25-1076, the Board awarded the RFP and approved Agreement for Services 9685 (Agreement) with BRI.
The First Amendment (Amendment) to the Agreement will amend Exhibit B, Rate Schedule adding add flat rate amounts for standard appraisal and acquisition services. The flat rate will simplify billing and increase efficiency for procuring these services. The change to the rate sheet does not affect the hourly rates in the original agreement. This minor modification does not significantly change the intent of the Agreement or County administrative processes. The changes are purely to clarify compensation for services to BRI.

The Board could direct Transportation not to approve the Amendment or to make changes and return to the Board at a later date.

FINANCIAL IMPACT
There is no change to net County cost. Funding for the Agreement will be provided by various project budgets, including federal, state, and local funding sources. 2) The Clerk of the Board will forward one (1) fully executed copy of the Amendment to the Chief Administrative Office, Contracts and Procurement Unit, for further processing.
