DISCUSSION / BACKGROUND
The Chief Administrative Office (CAO) requested that the bargaining unit designation for an existing vacant Administrative Analyst I/II position be modified from Professional (PL) to Confidential (CO) based on the position’s intended ongoing assignment within the CAO’s executive administrative office. This request does not create a new position; it re-designates an existing vacant position to align the bargaining unit with the work and level of confidentiality required for the assignment.
In the CAO assignment, the position will provide recurring confidential analytical and administrative support to executive leadership, primarily supporting the Administrative and Budget divisions. The position’s core duties are expected to include: administering and coordinating the County’s Public Records Act (PRA) program for the CAO's office through GovQA, including review and redaction of records that may include personnel and employee relations information, preparing and consolidating internal pre-adoption budget drafts and other sensitive fiscal materials for executive review, developing labor-related costing and briefing materials used in management-level deliberations, and supporting department head evaluation processes, including preparation and coordination of closed-session evaluation materials with Human Resources and County Counsel.
Human Resources reviewed the requested assignment and the identified ongoing work products for this position. Because the position will have routine access to, and responsibility for handling, confidential employer-employee relations information as part of its regular duties in the CAO's office, and because the assignment is structured as an ongoing confidential support function rather than incidental exposure, Human Resources recommends the position be allocated to the Confidential (CO) unit consistent with Personnel Rule 225 and the County’s confidential unit determination standards.
ALTERNATIVES
The Board could decline to approve the bargaining unit modification, which would require shifting the confidential functions to existing staff as it is structured currently.

FINANCIAL IMPACT
