Community Development Agency, Long Range Planning, recommending the Board approve and authorize the Purchasing Agent to sign Amendment III to Agreement for Services No. 396-S1211 with Kimley-Horn and Associates, Inc. for Travel Demand Model creation and update services, expanding the scope of work and increasing the not-to-exceed amount of the Agreement by $16,000 for a new not-to-exceed total amount of $501,477, and extending the term of the Agreement to December 31, 2015, contingent upon review and approval of the Amendment by County Counsel and Risk Management.
FUNDING: The total contract is funded by a combination of Traffic Impact Mitigation Fees, Road Fund, and General Fund. Amendment III is specifically funded by the General Fund (no Federal Funding).

The agreement with Kimley-Hornand Associates, Inc. (KHA) is a budgeted expense in the FY13/14 Long Range Planning Division's budget. Funding for tasks to be completed under the agreement in FY14/15 will be included in the Long Range Planning Division's FY14/15 budget proposal.
Background
On January 24, 2012, the Chief Administrative Office recommended the Board authorize the Purchasing Agent to execute Agreement 396-S1211 with KHA to create a new Travel Demand Model (TDM) for the County. Components of the original contract included updating data and creating the new TDM and analysis needed for the Targeted General Plan Amendment (TGPA) and Zoning Ordinance Update (ZOU) environmental document.
On October 22, 2013, the Board authorized Amendment II to Agreement 396-S1211, revising the scope of services to add two additional tasks, and extending the term through July 31, 2014.
On January 15, 2014, $6,860 was transferred from Task 2.3 to Task 4.4 of Agreement 396-S1211 to enable KHA to prepare and deliver a presentation at the Board of Supervisors meeting on February 24, 2014. Since KHA created the TDM, it is the firm most qualified to discuss TDM model creation in detail.
This Amendment III to Agreement 396-S1211 is necessary to replenish the budget for Task 2.3, and add a contingency in the ammount of $9,140 to provide for additional services that may be requested by the Board of Supervisors.
Recommendation:
In order to meet the stated goals and objectives, staff is requesting the Board authorize Amendment III to Agreement 396-S1211 with KHA.
