Title

Human Resources Department recommending the Board:

1) Approve and adopt the new department-specific classifications of Chief of Innovation and Technology Transparency and Special Investigator I/II (District Attorney) and new classification of Investigative Assistant I/II;

2) Approve and adopt the revised classification specification of Chief Assistant District Attorney and Lieutenant (District Attorney) (title change from Assistant Chief Investigator); and

3) Approve and authorize the Chair to sign Resolution 023-2025 to:

a) Approve the Job Class Number, bargaining unit, and salary range for the Chief of Innovation and Technology Transparency, Investigative Assistant I/II, and Special Investigator I/II (District Attorney);

b) Approve the title change from Assistant Chief Investigator to Lieutenant (DA);

c) Due to lateral reclassification, approve the deletion of 5.0 full-time equivalent (FTE) Investigative Assistant positions (4.0 - District Attorney and 1.0 - Public Defender) and the addition of 5.0 FTE Investigative Assistant I/II positions where the competitive recruitment and selection process is being waived by the Director of Human Resources at the request of the appointing authorities in accordance with Personnel Rule 507.1.1; and

d) Abolish the Investigative Assistant and Special Investigator (District Attorney Non-Sworn) classifications.

DISCUSSION / BACKGROUND

The District Attorney’s Office has requested several changes to existing classifications and the adoption of a new classification to meet organizational needs and operational priorities. Below is a detailed explanation of the proposed changes:

 

Chief of Innovation and Technology Transparency (CITT)

The District Attorney’s Office seeks to establish the new classification of CITT to enhance transparency, accountability, and data-driven decision-making within the office. This position will oversee the District Attorney’s IT operations, implement innovative technology solutions, and promote collaboration between technical and legal functions. The classification study conducted by Human Resources supports the creation of this role, emphasizing its importance in modernizing operations and improving public trust.

 

Retitling Assistant Chief Investigator to Lieutenant (District Attorney)

To align with industry norms and simplify the hierarchy within the investigative division, the Assistant Chief Investigator classification will be retitled as Lieutenant (DA). This change reflects the nature of the role without altering its existing duties or responsibilities.

 

Flexible Staffing of Investigative Assistant and Special Investigator

The District Attorney’s Office has faced challenges in recruiting for investigative classifications. Human Resources recommends revising the Investigative Assistant and Special Investigator classifications to be flexibly staffed. This change allows for the progression of incumbents who meet the qualifications and successfully perform at the higher level, as determined by the appointing authority and the Director of Human Resources. This adjustment mirrors the flexibly staffed model adopted for other County classifications to enhance recruitment and retention efforts.

 

Investigative Assistant Reclassifications

-Lateral Reclassification of 5.0 FTE positions from Investigative Assistant to Investigative Assistant II in the District Attorney's Office and Public Defender.

-Pursuant to Personnel Rule 507.1(1) as listed above, the competitive recruitment and selection process will be waived, since the incumbent of the filled position meets the conditions required under Section 507.1(1) of the Personnel Rules. The reclassification is the result of the class study affecting all employees in an occupational field, and the incumbents meet the minimum qualifications of the new class. Additionally, the appointing authority has requested that the Director waive the competitive recruitment and selection process for this position.

-In accordance with Personnel Rule 507.1, a waiver of the probationary period of the incumbent is granted by the appointing authority with approval from the Director on the grounds that the employee has already satisfactorily performed the duties of the new classification for the length of the probationary period of the new class.

-The salary is proposed to be set consistent with Personnel Rule 612.1, Lateral Reclassification.

 

Chief Assistant District Attorney

The Chief Assistant District Attorney classification is currently restricted to a single position. The District Attorney’s Office requests that this limitation be removed to allow the addition of a second position, if necessary. This update will provide flexibility to address increased workloads and succession planning needs.

 

ALTERNATIVES

The Board could choose not to adopt the proposed class specification, retitle, staffing changes, or classification updates. This could impact the District Attorney’s ability to address operational challenges effectively and retain qualified staff.

FINANCIAL IMPACT

There is no financial impact associated with this item since the item is not adding any additional allocations and the salary range for the Investigative Assistant II is the same as the salary range for the former Investigative Assistant classification therefore the incumbents’ salary will not change.
